Please find attached proposed amendments to Resolution No. 94-15. The proposed amendments are illustrated below in Ramseyer format with respect to the contents of Resolution No. 94-15 (material to be deleted is bracketed and stricken: material to be added is underscored). A draft copy of Resolution No. 94-15, Draft 2, is attached with the proposed amendments incorporated. The title is amended to read as follows: "A RESOLUTION URGING THE HAWAII STATE [HOUSEOF REPRESENTATIVES4LEGISLATURE TO PASS HOUSE BILL NO. 1267 RELATING TO PUBLIC LANDS." The enacting clause is amended to read as follows: "BE IT RESOLVED BY THE COUNCIL OF TBE COUNTY OF HAWAPI the Hawaii State [House ,.a�es] Legislature is urged to pass House Rill No. 1267 relating to public lands. "I he final clause is amended to read as follows: "BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the I Ionorable Governor David Y. Ige, the Honorable Senate President Donna Mercado Kim, the Honorable Speaker of the House of Representatives Joseph M. Dara AR 4 201 March 4. 2015 Page 2 of A RESOLUTION URGING THE HAWAII STATE LEGISLATURE TO PASS HOUSE BILL NO. 1267 RELATING TO PUBLIC LANDS. WHEREAS, the Department of Land and Natural Resources (DLNR) is responsible for the management of State-owned lands_ and is assigned to promote the well-being of I lawari's people and insure that these lands are used in accordance with the goals, policies, and plans of the State; and WHEREAS, DLNR has the responsibility of planning for the disposition of commercial, industrial, hotel- and resort classes of public lands to determine specific uses, minimum size of parcels, required building construction or improvements, and lease terms and requirements:. and WHEREAS, under current laws and policies that guide the management of these public lands-, many lessees face uncertain futures following the expiration of their leases, forcing them to re -locate or close their businesses; and WHEREAS, these lessees have little incentive to make major investments in infrastructural improvements or to ensure the long-term maintenance of facilities because their tenancies may not continue which may result in the deterioration and dilapidation of infrastructure and facilities; and WHEREAS, House Bill No. 1267 establishes a four-year redevelopment pilot project for the Kanoclehua Industrial Area (KIA); and WHEREAS, the purpose of the pilot project is to establish a planning committee to prepare a development plan, define policies for the management of public lands, and most importantly, to examine the barriers that hinder redevelopment of infrastructure in the KIA; and March 4. 2015 Page 3 of 3 WHEREAS, designating an arca of public lands in the KIA to serve as a designated redevelopment district under the advisement of a planning committee comprised of I lawai`i Island residents will benefit the area, the lessees, the inventory of public land, and the local economy; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI9 that the Hawai'i State Legislature is urged to pass House Bill No. 1267 relating to public lands. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Governor David Y. Igc, the Honorable Senate President Donna Mercado Kim, the Honorable Speaker of the House of Representatives Joseph M. Souki, the Honorable Senator Laura H. Thielen, the Honorable Senator Jill N. Tokuda and the Honorable Representative Sylvia Luke.
