The day before Thanksgiving, Ordinance 13-121 was invalidated by a federal court because it was preempted by Hawaii state law and "is, in part, expressly preempted by the federal Plant Protection Act". Council was told that this would happen in testimony before Ordinance 13-121 was adopted. That testimony was ignored by the Ordinance's supporters on Council. I ask you to please oppose an appeal of the Court's ruling. We can not afford to waste any more of the County's limited funds on doomed lawsuits that, in the end, only benefit the lawyers.
