Aloha Kakou,
My name is Diane Kanealii, I am a lifelong resident of Moku 'O Keawe. I am here to day to testify in
support of resolution 22-14.
I ask that YOU, as representatives of this island, appeal the court ruling that overturned the GMO ban
ordinance.
I am not sure if planting and maintaining GMOs are safe or not, and I personally think that NOT being
sure IS the problem. I do not want to see our island paradise in a situation that is irreversible. Have
we not learned from what is happening on our other islands?
This island has to potential of become the mecca of non-GMO foods. More expensive? Probably, but
I speak today for the wealth of a healthy environment and not about the wealth that lines someones
pockets. We now have a choice to buy GMOs that come off the ship or buy local non-GMO products .
If, the ban on GMO crops is repealed, we will NO longer have that choice. Let us err on the side of
precaution. We can always change our minds later.
With all that said, let's go to the core of the current issue which is that Judge Barry Kurren concluded
that, although the Hawaii Pesticide Law does not contain any provisions that actually conflict with the
Kauai ordinance's requirements, the state law's broad scope implied that the Hawaii legislature
intended that only the state government had the authority to regulate pesticide matters.
The court also ruled that federal laws do not preempt the ordinance, so therefore leaving the
possibility that the state could amend its laws to protect its residents without running afoul of federal
Iaw.So while the County's law does not actually conflict with State law, it somehow runs afoul of an
*implication of an intention* in the State law. But on the other hand, the State is perfectly free to amend its laws
"without running afoul of federal law." I believe that YOU as our representatives have the responsibility to fight
for our future and protect home rule for issues that impact our island . Please SUPPORT resolution 22-14 .
