Subject: Support Appeal Overturning Ordnance 13-121
Aloha County Council;
I urge you to appeal Judge Kurrems ruling overturning Ordinance 13-121 and take it to a higher court. I am an organic
farmer on the Hani coast and will feel the impact of this ruling directly.
Island residents testified in the thousands and voted in support of the measure - taking that away from us hardly seems to
follow democratic process. It seems to smack of corruption, especially when the judge has ties to GMO interests.
As Mayor Kenoi said in signing the bill, "We all want to minimize impacts to the environment while also producing
abundant, affordable food for local consumption. This ordinance expresses the desires and demands of our community for
a safe, sustainable agricultural sector that can help feed our people while keeping our precious island productive and
healthy."
The principle of preemption is to prevent conflict between laws, so that the laws on the higher level of government prevail
in cases of conflict. In this case there are no Hawaii state laws or regulations relating to the cultivation of GMO
crops/plantsother than one Department of Health provision about state notification of proposed federal experimental
GMO seed testing permits, so Ordinance 13-121 should be the prevailing law on the matter.
Please do the right thing - exercise our right to protect our health and aina - appeal this ruling.
