Aloha,
We are unable to attend the Council meeting to submit testimony in person. Thank you for the
opportunity to present our views via email.
We support Communication 9.1. We do not see any "conflict of interest" in allowing Paul
Achitoff and George Kimbrell to represent the County of Hawai'i in the appeal of the lower
court's decision invalidating the County's GMO restriction ordinance (Bill 113). In fact, we
think it is appropriate and beneficial to have experienced and knowledgable attorneys
addressing this issue on our behalf. We're also appreciative of the opportunity to have
representation without having the tax payers (us) footing huge litigation costs.
We're incensed over the fact that there is even a need for this appeal in the first place.
We think the County of Hawai'i should have the ability to legislate matters that affect
agriculture on our Island without that legislation being overturned. We feel strongly that
the County has the right to restrict additional GMO crops being allowed here and we hope to
have Bill 113 upheld. Having expert attorneys represent the County can help achieve this
goal.
Please hire special counsel Paul Achitoff and George Kimberly to represent the county of
Hawai'i and its citizens.
