RESOLUTION NO. 128 15
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER
FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A
MULTI-YEAR LEASE OF REAL PROPERTY
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease
or other obligation requiring payment of funds from the appropriations of a later fiscal
year or of more than one fiscal year be approved by resolution; and
WHEREAS, the Department of Public works presently leases property at 81-6394
Mamalahoa Highway, Kona, Hawaii, Tax Map Key: (3) 8-1-016:039 (por.) and the use
of a forty (40) foot storage container located on the site for the purpose of parking
vehicles, and for storage of equipment and supplies; and
WHEREAS, the Department of Public works wishes to enter into a multi-year lease
agreement for additional office space consisting of two buildings and parking space
located on the same Tax Map Key parcel, and next to the property indicated above; now
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
1. That the Mayor is hereby authorized to enter into a five (5) year lease
agreement for property located at 81-6394 Mamalahoa Highway, Kona,
Hawaii, Tax Map Key: (3) 8-1-016:039 (por.).
2. That sufficient funds be budgeted in future fiscal years to cover the
anticipated obligations of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii
shall transmit copies of this resolution to the Office of the Mayor, the Department of
Public Works, and the Finance Department.
