REPORT OF THE <br />COMMITTEE ON FINANCE <br />DATE: March 17, 2015 <br />PLACE: Council Chambers <br />Kailua-Kona, Hawaii <br />TIME: 2:32 p.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Re: Comm. No. 168/Res. No. 104-15 <br />Your Committee on Finance, to which was referred Resolution No. 104-15, reports as follows: <br />Resolution No. 104-15, transmitted by Finance Director Deanna S. Sako, via Communication No. 168 <br />dated February 27, 2015, authorizes the abandonment and sale of that certain parcel, Tax Map Key <br />(3) 2-1-009:037 situated at Waiakea, District of South Hilo, County and State of Hawaii, to Hoku Kai <br />Biofuels, LLC. <br />This resolution allows the County of Hawaii to dispose of a 733 square foot parcel by way of sale to Hoku <br />Kai Biofuels, LLC due to a fuel pipeline, vault, and valve system on the parcel which poses a risk to the <br />County in the event of a leak. <br />This parcel has been determined to be economically and physically unsuitable or undesirable for <br />development or utilization due to its size, shape and location. <br />Finance Property Manager Hamana Ventura, Deputy Corporation Counsel Belinda Castillo, and <br />representatives of Hoku Kai Biofuels LLC, Chuck Barker, George Smith and Tad Piper appeared before <br />Your Committee for questions. <br />There was no discussion on this measure. <br />Pursuant to Section 2-111 of the Hawaii County Code, the Council may direct the Director of Finance to <br />dispose of real property in fee simple. <br />Pursuant to Section 2-118(b) of the Hawaii County Code, remnants or portions thereof may be disposed of <br />without recourse to public auction and shall be first offered for sale to the abutting landowner. <br />Pursuant to Section 2-118(d) of the Hawaii County Code, disposition costs may be added to the sale price. <br />Your Committee on Finance is in accord with the purpose and intent of Resolution No. 104-15, and <br />recommends its adoption. <br />wb <br />Respectfully submitted, <br />COMMITTEE ON FINANCE <br />KAREN EOFF, CH IR <br />FC REPORT NO.: 13 <br />ADOPTED: APR 0 1 2015 <br />AYES NOES ABS EX <br />CHUNG <br />X <br />DAVID <br />X <br />EOFF <br />X <br />ILAGAN <br />X <br />KANUHA <br />X <br />ONISHI <br />X <br />PALEKA <br />X <br />POINDEXTER <br />X <br />WILLE <br />X <br />Respectfully submitted, <br />COMMITTEE ON FINANCE <br />KAREN EOFF, CH IR <br />FC REPORT NO.: 13 <br />ADOPTED: APR 0 1 2015 <br />
