Goldstein, Planning Director County of Hawaii Planning Department 25 Aupuni Street Hilo, Hawaii 96720 Subject: Annual Report Development Agreement No. 1 By and Between the County of Hawaii and Oceanside 1250 Dear Ms. Goldstein: I am pleased to submit the following annual report for Development Agreement No. 1 ("Agreement") by and between the County of Hawaii ("County") and Oceanside 1250 ("Oceanside"), in accordance with Item 24 of said Agreement. In April of 1998, Oceanside 1250 and the Hawaii County entered a Development Agreement to identify the obligations of Oceanside, to provide assurance that these obligations are met in a timely manner, to provide assurances to Oceanside that it may complete full development of the Hokukano Project ("Project") and the Mamalahoa Highway Bypass ("Bypass"), to allow Oceanside and the County 74-5620A Pulani Road to enter a reimbursement agreement for costs associated with the Bypass and to reduce or eliminate uncertainty in the responsibilities of Oceanside and the said zoo County relating to the development of the Project and the Bypass. The scope and purpose of the Development Agreement is consistent with Ordinance 93-37, the Kailna-Rona, xawafi Development Agreement Code and Rule 1, which implements procedures for the application, preparation and administration of development agreements as 967ao-lezs provided by Ordinance 93-37. The Development Agreement was executed and approved by the Mayor on April Z0, 1998. Tcl: 808-326-2966 Mamalahoa Highway Bypass Fax: A08-3z6-7713 The Mamalahoa Highway Bypass is inpart, designed to address existing traffic conditions in the area and to provide an alternative route for interregional traffic between North and South Kona in support of the County's long-range traffic plan. Oceanside 1250 has made further refinements to the Bypass route based on extensive, ongoing discussions with the various landowners. Now that the alignment issues have been agreed to by the landowners, we are completing a Draft Environmental Impact Statement (DEIS) for the roadway. The DEIS will be submitted to the County of Hawaii Department of Public Works, who is the 00©455 Ms. Virginia Goldstein January 14, 1999 Page Two accepting agency for the DEIS as well as the Final Environmental Impact Statement. The Department of Public Works is also the responsible agency for determining the final alignment, roadway standards and construction specifications for the Bypass, as outlined in Item 13 of the Agreement. Oceanside has continued its discussions with each of the landowners along the Bypass route regarding acquisition of right-of--way sufficient to build the road, and we have finalized options to purchase these portions of the right-of--way from many of the landowners. Coastline Park Oceanside has completed and filed with the Planning Department the Public Access and Shoreline Management Plan ("Plan") as noted in Item 17 of the Agreement regarding public access areas, perpetual access covenants, archaeology, marine resources and related improvement measures. The Plan includes measures for mauka-makai and lateral shoreline accesses, parking area(s), signage, emergency response considerations, restrictions on use, provision of recreational and restroom facilities and related improvements. The Plan also integrates public accessways to the trail system and to appropriate historical and archaeological sites. Details of the provisions for historical sites will be developed and implemented as part of the comprehensive archaeological mitigation plan for the Project. In addition, Oceanside will be seeking CDUA and SMA permits in order to develop the facilities in the Coastline Park that are outlined in the Plan. These permits must be applied for within one year of approval of the Public Access Plan. Members' Lodge We are currently conducting various architectural and planning studies for the lodge facilities, its development, phasing and scheduling in preparation for filinf an SMA application. Ms. Virginia Goldstein January 14, 1999 Page Three Archaeology Oceanside has contracted with a professional archaeological consultant firm to prepare the required archaeological mitigation and interpretation plans including a data recovery plan, an interim protection/preservation plan and along-term preservation plan in consultation with DLNR and Hawaiian community organizations. As required by the terms of the land use entitlements for the Project, approved mitigation measures will be implemented prior to or in conjunction with any land alteration on the property. Subdivision On December 9, 1998, the Planning Department issued tentative approval of the preliminary plat map for 387 lots plus roadways and easements for the first increment of residential/agricultural lots in the project. Other Items Currently, Oceanside is preparing flood and drainage studies, solid waste management plan and a natural resource management plan among other plans and studies that are necessary for development the Project and the Bypass. There are no other items to report that affect the status of the Project or the Bypass as it relates to the terms of the Agreement. Oceanside 1250 intends to meet all of the teens and comply with all of the conditions that are specified within the Agreement.
