RIYOSARI, CHIEF ENGINEE SUBJECT: REONELEHUA HEIGHTS PROJECTS The following are responses to your memo of February 5, 1997. 1. Has your department reviewed the proposed pre-emptions? Yes. 2. If so, what effects will these pre-emptions have oa the department's ezisting standards for any improvements normally required for a development of this sine and the conditions already imposed by the previously approved documents noted above? These pre-emptions are in accordance with HRS 201E-210 which deals with affordable housing projects only. Therefore, this will have no effect on normal subdivision standards. The pre-emptions for affordable housing projects are decided on a case-by-case basis. 3. If any standards will be changed by these pre-emptions, what effect will such changes have oa the issues of public health, safety, and welfare? These pre-emptions, as required by law, meet minimum requirements of health and safety. 4. Will the County (ie. tazpayers) be ezposed to any additional liability, if any, if all of these are approved? While this matter should be referred to the Corporation Counsel, in accordance with HRS 201E-210, "NO action shall be prosecuted or maintained against any county, its officials, or employees, on account of actions taken by them in reviewing, approving or disapproving the plans and specifications." 5. If so, will your department be willing to endorse these pre-emptions inspite of these? Our department's responsibilities are to review the construction plans for minimum requirements of health and safety. These plans are consistent with these requirements.
