Schutte DATE: September 25, 1991 (Wednesday) PLACE: Councilroom TIME: 10:00 a.m. CALL TO ORDER STATEMENTS REFERRALS Comm. 2788: LEGISLATIVE BILLS From IGRC Chairman James Arakaki, dated August 19, 1991, submitting for review S.B. 101, S.B. 1342 and S.B. 2113, all relating to the Land Evaluation and Site Assessment System (LESA). States these bills were held back in their respective committees during the 1991 legislative session. Further states he believes that one of the bills will be the basis for enacted legislation in 1992 and anticipates the Council will be submitting testimony on both the merits and shortcomings of the legislation. Requests the Planning Committee assess these proposals and formulate recommended positions and any additional suggestions as to the legislation. Comm. 2794: WATER REQUIREMENTS FOR SUBDIVISION AUGUST 14 1991--PLANNING COMMISSION HEARING From Corporation Counsel Michael J. Matsukawa, dated August 21, 1991, informing of his concerns on two water variance appeals, both denied by the Planning Director, that were reviewed at the Planning Commission's hearing on August 14, 1991. States the Planning Commission took the appeals under advisement and there is a possibility that at their next hearing they may overrule the Planning Director's PC-63 Page 2 September 25, 1991 Comm. 2794: denial of both variance requests, and that if the (Cont'd) Commission were to find that the Director had abused his discretion or had committed an error of law in denying the water waiver requests, the Commission would be the arbiter of subdivision policy regarding water requirements. Requests a meeting of appropriate representatives from the Administration and Council to discuss the matter before the next meeting of the Planning Commission. Comm. 2806: E.I.S. FOR WATER RESOURCE DEVELOPMENT AND ACROSS ISLAND TRANSMISSION (42 INCH PIPELINE ALONG THE SADDLE ROAD) Copy of letter to Donald Okahara, Okahara and Associates, Inc., and Edward Lau, State Department of Land and Natural Resources, from Henry A. Ross, dated July 22, 1991, regarding the E.I.S. on the proposed water project along the Saddle Road. Comm. 2807: E.I.S. FOR THE KAWAIHAE TEN-YEAR MASTER PLAN Copy of letter to Stephen Kellogg, R.M. Towill Corporation, from Henry A. Ross, dated July 22, 1991, regarding his concerns on traffic and water that he would like addressed in the E.I.S. for the Kawaihae Ten-Year Master Plan. Comm. 2847: CHANGE OF ZONE APPLICATION (Bill 487) APPLICANT: WAIKOLOA DEVELOPMENT CO. TWK: 6-9-7:1-14, 17, 19-21, 26, 30-37; AND 6-9-8:1-13, WAIKOLOA, SOUTH KOHALA (FORMERLY 6-8-1:26: AND 6-9-7:1-30) (858+ ACRES From Planning Commission Chairman Mike Luce, dated September 6, 1991, submitting a bill to change the district classification for approximately 858± acres of land from Unplanned (U) to Multiple-Family Residential-4,000/6,000/8,000 square foot (RM-4/RM-6/RM-8); Open (O); Village Commercial -10,000 square foot (CV-10); and Limited Industrial-20,000 square foot (ML-20) zoned districts. States the site is the existing Waikoloa Beach Resort and those lands on the mauka side of the Resort to the Queen Kaahumanu Highway extending from the State-owned lands on the south to Mauna Lani Resort on the north, in the ahupua'a of Aneho'omalu and Waikoloa, South Kohala. PC-63 Page 3 September 25, 1991 Comm. 2848: ANNUAL PROGRESS REPORT CHANGE OF ZONE ORDINANCE NO. 90-85 APPLICANT: CHARLES FOREMAN AND JBE ASSOCIATES TMK: 7-5-4:6 AND 13 Copy of letter to Ivan Nakano, Vice President, David S. De Luz Sr. Enterprises, Inc., from Planning Director Norman K. Hayashi, dated August 30, 1991, acknowledging receipt of their annual progress report, in compliance with Condition M of Ordinance No. 90-85. Informs that Condition B of the ordinance states that the required water commitment payment, to be submitted to the Department of Water Supply (DWS) by October 15, 1990, has not been received by them; therefore, he is to contact DWS as soon as possible for the proper procedure for payment of the fee and to notify the Planning Department when the payment is made. Further informs that Condition C requires that plans for consolidation/resubdivison of the affected properties shall be submitted within one year from the effective date of change of zone; however, he understands that either a pending related subdivision plan will be revised to comply with the condition or will request an administrative time extension to submit a new plan. Comm. 2849: TRAFFIC CONCERN - REQUEST FOR CHANGE OF ZONIN From Marjorie Kenty-Chamberlin, dated September 3, 1991, regarding a request for change of zone from Ag to Commercial Ag on a 5-acre parcel of land off Pahoa Hwy. States the area is small and very close to Kahakai Blvd. which carries a heavy load of traffic which has further increased by the opening of the new school. Requests the situation be carefully studied before a commercial venture is permitted in this area. Comm. 2856: From Marjorie Kenty-Chamberlin, dated September 10, 1991, commenting on an article which appeared in the Hawaii Tribune Herald on September 8, 1991 indicating that the Planning Commission approved plans for a Food Fair supermarket to be located near the fork splitting the new Pahoa bypass road from the Pahoa town road. States she does not object to having a market in Pahoa but prefers it be built at another location, for reasons, as listed. PC-63 Page 4 September 25, 1991 Comm. 2857: REQUEST FOR TIME EXTENSION CHANGE OF ZONE ORDINANCE NO. 88-56 (REZ. 585) SUBDIVISION NO. 88-157 APPLICANT: KULALANI RANCH/STEPHEN ARNETT TMK: 8-1-5:02 Copy of letter to Michael Moore, Esquire, Menezes, Tsukazaki, Yeh & Moore, from Planning Director Norman K. Hayashi, dated September 10, 1991, responding to his request for a one-year time extension to secure final subdivision approval in compliance with Condition C of Ordinance No. 88-56 and to submit the final plat map in compliance with Condition No. 11 of tentative subdivision approval, dated October 31, 1990. States a one-year time extension until October 31, 1992, to submit the final plat map and to secure final subdivision approval, is granted. Comm. 2879: PROPOSED AMENDMENTS TO BILL NO. 460 RELATING TO ADDITIONAL DWELLING From Takashi Domingo, PC Chairman, dated September 11, 1991, transmitting for information proposed amendments to Bill No. 460 relating to Additional Dwelling. States the amendments were made to address concerns of the Council and the public. Comm. 2880: From John E. Gilger and Irma J. Gilger, dated September 16, 1991, transmitting a copy of a Realtors advertisement and copy of Declaration of Covenants, Conditions and Restrictions for the Kona Acres Subdivision and questioning why permits are being issued to build in violation of the Subdivision Covenants.
