SUBJECT: A Proposed Amendment to Bill No. 40; a Bill for an Ordinance to Amend
Chapter 15, Articles 2 and 3, of the Hawaii County Code 1983 (2005
Edition, as amended), Relating to Parks and Recreation.
Please see below a proposed amendment to Bill No. 40. The proposed amendment to the Bill is
illustrated in Ramseyer format with respect to the contents of Bill No. 40 (material to be deleted
is bracketed and stricken; material to be added is underscored). Due to the limited scope of this
proposed amendment, a draft copy of Bill No. 40, Draft 2, with the proposed amendments
incorporated, has not been attached.
SECTION 4 of Bill No. 40, that proposes an amendment to section 15-35, of the Hawaii
County Code 1983 (2005 Edition, as amended), is amended by amending subsection (a) of
section 15-35 to read as follows:
"(a) As used in this section, "expressive activities" means speech or conduct,
the principal object of which is the expression, dissemination, or
communication by verbal, visual, literary, or auditory means of political,
religious philosophical, or ideological opinions, views, or ideas and for
which no fee is charged or required as a condition of the participation in or
attendance at such activity. Expressive activity generally would not
include sports events [suchas--s,.,a.ca„t'� ans(, fundraising events, beauty
contests. commercial events. cultural celebrations or other events where
the principal purpose Iof v hich) is entertainment."
