Pommerenk, President, Kapoho Community Association, dated August 19, 1991, stating that Ormat has violated many of the conditions of Geothermal Resource Permit 87-1.0, as listed, and requests that the permit be reviewed. Comm. 2804: SPECIAL MANAGEMENT AREA (SMA) USE PERMIT ASSESSMENT APPLICATION HAWAII TROPICAL BOTANICAL GARDEN TAX MAP KEY: 2-7-9:2 AND 2-7-10:22 Copy of letter to Dan J. Lutkenhouse, Founder and Director, Hawaii Tropical Botanical Garden, from Planning Director Norman K. Hayashi, dated August 23, 1991, responding to his letter of July 22, 1991, together with his SMA Use Permit Assessment Application and supporting information for the proposed construction of a new access road, parking area, foot bridge, rain shelter, restrooms, foot trails and expansion of botanical garden. States the SMA Use Permit Assessment Application is reviewed to assess, cumulatively, the proposed project and to determine whether a SMA Minor Permit or a SMA Major Use Permit is required, and that based on the PC-62 Page 2 September 11, 1991 Comm. 2804: information submitted, it was determined that the (Cont'd) appropriate procedure would be to pursue obtaining a SMA Major Use Permit from the Planning Commission as the proposal is considered part of a larger expansion plan; therefore, their decision in his previous submittal was not a denial of a permit but to direct him to the appropriate permitting procedure. Comm. 2839: From Calvin K. Mukai, dated August 30, 1991, regarding his concern of the lack of access to Onomea Bay shoreline where, for many years he fished, swam and surfed. States the area is now fenced up and barb wired with "NO Trespassing" signs. Further states that he realizes the area is private property but questions whether the shoreline is open to the public. Comm. 2808: CHANGE OF ZONE ORDINANCE NO. 88-152 APPLICANT: RICHARD R. TREADWELL SMA USE PERMIT ASSESSMENT APPLICATIONS AND BUILDING PERMIT APPLICATION/PLANS FOR CONSTRUCTION OF SINGLE FAMILY DWELLINGS TMK: 6-6-02: 3, 4, 5 AND 6 Copy of letter to Roy A. Vitousek, III, Esq., Cades Schutte Flemming & Wright, from Planning Director Norman K. Hayashi, dated August 23, 1991, acknowledging receipt of letters dated July 8, 15, 18 and 19, 1991, regarding his denial to an administrative time extension to Condition B (complete construction) of Ordinance No. 88-152 and the processing of the SMA Use Permit Assessment Applications and building permit application/plans. States they are being granted a two (2) year time extension to Condition B of the ordinance to complete construction of single family dwellings on two of the lots by October 27, 1993. Informs that with this time extension granted, the appeal filed with the Board of Appeals and the time extension request to the Council are not necessary and, as such, no further action is required for these requests. Comm. 2840: RESOLUTION NO. 315 91 FEASIBILITY STUDY OF GENERAL PLAN AMENDMENT AT AWAKE'E TMK: 7-2-04:PORTION OF 17 From Planning Director Norman K. Hayashi, dated August 29, 1991, responding to the subject resolution requesting the Planning Department to conduct a study to determine the feasibility of amending the General Plan to redesignate the land at Awake'e from Resort and Medium Density Urban to Open. Informs he will be initiating a General Plan amendment to redesignate the subject area back to Conservation concurrently with a General Plan Amendment petition filed by the North Kona Development Group for the land exchange area at Manini'owali and Kukio 2nd; therefore, states a feasibility study would not be necessary.
