Your Committee on Finance, to which was referred Bill No. 39, reports as follows:
Bill No. 39, transmitted by Finance Director Deanna S. Sako, via Communication No. 233 dated
March 24, 2015, amends Chapter 14, Article 13, of the Hawai`i County Code 1983 (2005 edition, as
amended), Related to Soliciting for Money or Objects of Value.
This bill amends multiple definitions and what constitutes a prohibited act to expand and more clearly
define first amendment protections for solicitation-related activity.
Corporation Counsel Molly Stebbins appeared before Your Committee and commented that this bill
was created to strike a proper balance between public safety concerns and first amendment protections.
Council Chair Dru Kanuha explained that this bill was introduced by request and that Corporation
Counsel drafted this bill in conjunction with the American Civil Liberties Union.
Your Committee on Finance is in accord with the purpose and intent of Bill No. 39, and recommends
its passage on first reading.
