Your Committee on Planning, to which was referred Bill 38, reports as follows:
Bill 38, transmitted by Mayor William P. Kenoi via Communication No. 232 dated March 20,
2015, amends Ordinance No. 08-115, which amended Ordinance No. 93-36, which reclassified
lands from Agricultural -20 Acres (A -20a), Agricultural -10 Acres (A-IOa) and Agricultural -3
acres (A -3a) to residential and agricultural -1 acre (RA -la) at Kukuau 1st, South Hilo, Hawaii,
covered by Tax Map Keys: 2-4-082:001-56, 58-61 (formerly 2-4:008: Portions of 014 and 026).
(Applicant: Moaniala Holdings, LLC) (Area: 171.84 acres).
This bill amends the following conditions of approval contained in Change of Zone Ordinance
No. 08-115: B (Water commitment payment), C (Time extension to secure Final Subdivision
approval for remaining phases and deletion of a construction bond to construct the Kupulau
Street Extension); D (Construction of Kawailani Street and Kupulau Street Extensions); and H
(Fair Share Credits for Road Improvements).
The Windward Planning Commission recommended approval of this bill at its duly held public
hearing on March 5, 2015.
Your Committee on Planning is in accord with the purpose and intent of Bill 38, and
recommends passage on first reading.
