Re: Agreement with the State of Hawai'i Department of Land and Natural Resources
The Hawaii County Public Access, Open Space and Natural Resources Preservation
Commission cited Kabuku Coastal Property as a site to expand monitoring, management
and protection of potential Hawksbill turtle nesting habitat where there are "Lands or
property entitlements with high public interest, imminent needs for acquisition, and
largest benefit to the general public"
The State of Hawaii Department of Land and Natural Resources (DLNR) applied for and
received a grant from the United States Department of the Interior, Fish and Wildlife
Service (USF&W) on behalf of Hawai'i County. This grant is for the acquisition of the
Kahuku Coastal Property in Ka'u, Hawaii by way of a subgrant to the County.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the DLNR
in order to receive a subgrant to acquire this property, which is comprised of
approximately 3,127.95 acres of land and is identified by Tax Map Key (3) 9-2-01:75.
We are requesting thatthis resolution be waived from the Finance Committee in order to
place it on the May b, 2015 Council Agenda in order to expedite the acquisition of this

On January 16, 2012 the State of Hawaii, Department of Land and Natural Resources, Division of Forestry
and Wildlife applied on behalf of the County of Hawaii for funding by grant from the United States,
Department of the Interior, Fish and Wildlife Service (USF&W) for acquisition of the Kahuku Coastal Property
in Ka`u, Island of Hawaii. This request was approved on September 10, 2012 by USF&W and by the Board
of Land and Natural Resources on February 27, 2015.

Explanation: The FUND is strictly a balance account that receives quarterly deposits
based on 2% of real property tax revenues. Monies in the FUND are not
necessarily earmarked for any one specific acquisition. As properties become
available for purchase and if money is available lands can be acquired based on
certain factors. In addition the County also got approved to receive 621,245.00
from the State, Legacy Lands Conservation Program.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above -referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
