Home My WebLink AboutRES 187 Draft 01 2014-2016COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 187 15 RESOLUTION AUTHORIZING THE ABANDONMENT AND DISPOSITION OF A PORTION OF PUAKO ROAD SITUATED AT PUAKO, DISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAII, BEING TAX MAP KEY: (3) 6-6-002(POR.) TO THE STATE OF HAWAII, DEPARTMENT OF LAND AND NATURAL RESOURCES, DIVISION OF STATE PARKS. WHEREAS, the County of Hawaii is the owner of that certain parcel of land located in Puak6, District of North Kohala, County and State of Hawaii, specifically identified as Tax Map Key: (3) 6-6-002, a portion of Puak6 Road, approximately 6.665 acres outlined as Parcel "C" in Exhibit "A" and detailed in Exhibit "B" which is currently unused by any County of Hawaii agency; and WHEREAS, the State of Hawaii, Department of Land and Natural Resources, Division of State Parks ("State"), has requested acquisition of a portion of this parcel for incorporation of this road into Hdpuna State Park; and WHEREAS, the departments of the County Hawaii have no objection to this request subject to the condition that the State adhere to the Hawaii State Fire Code, National Fire Protection Association version 2006, with County of Hawaii Amendments; and WHEREAS, pursuant to Section 2-111, Hawaii County Code, the Council may direct the Director of Finance to dispose of real property in fee simple; and WHEREAS, pursuant to Section 2-120, Hawaii County Code, remnants or portions thereof may be disposed of without notice or appraisal to a governmental entity; and WHEREAS, pursuant to Section 2-120, Hawaii County Code, disposition costs may be attributed to the State; and WHEREAS, pursuant to Section 46-7, Hawaii Revised Statutes, this Council's consent is required to enter into an agreement with State; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that said Tax Map Key: (3) 6-6-002 outlined as Parcel "C" on Exhibits "A" and "B" attached hereto, is hereby abandoned. BE IT FURTHER RESOLVED that the Director of Finance is authorized to sell the aforementioned remnant without recourse to public auction in a manner consistent with Section 46-7, Hawaii Revised Statutes and Section 2-120, Hawaii County Code, to the State of Hawaii, Department of Land and Natural Resources, Division of State Parks, adhering to Hawaii State Fire Code, National Fire Protection Association version 2006, with County of Hawaii Amendments and paying any disposition costs. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) Finance Director Deanna Sako; (3) State of Hawaii, Department of Land and Natural Resources, Division of State Parks; and (4) Deputy Corporation Counsel, Craig T. Masuda.
