Your Committee on Public Works and Parks and Recreation,to which was referred
Resolution No. 166-15, reports as follows:
Resolution No. 166-15,transmitted by Deputy Corporation Counsel Katherine A. Garson, via
Communication No. 266 dated March 23, 2015, accepts the dedication of Road Lot(12.5 feet wide
Right-of-Way), being a portion of Allotment 14 of Holualoa land 2 partition (mauka section) being a
portion of Royal Patent 4475, Land Commission Award 7713, Apana 43 to Victoria Kamamalu,
Tax Map Key: 7-6-004-:059, situated at Holualoa 1 and 2, District of North Kona, Island of Hawai`i, from
Millicent A. Grand, Successor Trustee of the Lillian U. Towata Revocable Living Trust dated
January 24, 1999.
The road lot contains an area of 1,657 square feet, and would be used for public road purposes.
Council Chair Kanuha, who supports Resolution No. 166-15, stated that he wanted more information on
Condition E of Ordinance No. 12-76, which requires an additional 12.5 feet wide Right-of-Way, along the
property's Old Government Road frontage,to be dedicated to the County. He informed the Council that
when this was proposed during Council in 1976,there was much discussion as to whether or not it should
be in the ordinance; however, it was passed as an amendment.
Deputy Corporation Counsel Katherine A. Garson appeared before Your Committee for questions.
She informed the Council that Resolution No. 166-15 is in compliance with the condition requirements of
Ordinance No. 12-76; furthermore, Ms. Garson included that all of the departments approved the
dedication before it was brought to Council.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and intent of
Resolution No. 166-15, and recommends its adoption.
