MINUTES The Committee approved the minutes of the September Committee meeting. Page 1 of 6 • IV. REPORTS A. Treasurer's Report 1. Treasurer's Report for September 2014 as submitted by the HSAC Treasurer The Committee approved the September 2014 Treasurer's Report, B. County Reports Maui County Report. Treasurer Victorino reported on the Maui Council's consideration of water conservation and vacation rental legislation. Treasurer Victorino also reported on the Lipoa Point land purchase, the HSAC legislative package, and the Maui County website. Maui Council Chair Baisa reported on the proposed Department of Health administrative rules changes regarding cesspools. Vice President Onishi stated that he will introduce a Hawaii Council resolution regarding the issue. President Rapozo requested that Vice President Onishi provide the Committee with a copy of the resolution when it is available. 2. Hawaii County Report. Vice President Onishi reported on Hawaii County's consideration of domestic violence, electronic cigarette, and sewer fee collection issues. 3. City and County of Honolulu Report. Alternate Anderson reported on the Honolulu Council's consideration and passage of "sit -lie" and homeowners' exemption legislation and the status of the 2015 HSAC legislative package. Alternate Anderson also stated that he and Secretary Martin support having HSAC Executive Committee meetings on the neighbor islands. Secretary Martin thanked the members for agreeing to meet today at 9:00 a.m. instead of 10:00 a.m. Secretary Martin stated that the 9:00 a.m. meeting time allows members to attend the signing ceremony for the Sister Cities agreement between Chigasaki City, Japan, and Honolulu, Hawaii. 4. Kauai County Report, President Rapozo reported on the Kauai Council's consideration of shoreline setback legislation and the 2015 HSAC legislative package. President Rapozo noted that the Page 2 of 6 Kauai Council did not approve the proposal relating to HSAC legislative priorities. The Committee received the county reports. C. NACo Report There was no NACo report. D. WIR Report Vice President Onishi reported on the WIR conference held at Malta, Montana. V. UNFINISHED BUSINESS There was no unfinished business. Vi. NEW BUSINESS A. Communication (October 9, 2014) from Council Chair Jay Furfaro, Kauai County Council, transmitting for the Executive Committee's information, the approved proposals to be included in the 2015 HSAC Legislative Package. President Rapozo stated that the Kauai Council passed all six HSAC legislative proposals but did not approve the list of proposed HSAC legislative priorities. President Rapozo noted that the Kauai Council suggested that the list of priorities be more specific. President Rapozo further commented that the Kauai Council did not want to give the HSAC Executive Committee broad authority in the matter. The communication was received. B. Communication (October 10, 2014) from City Clerk Bernice K. N. Mau, City and County of Honolulu, transmitting for the Executive Committee's consideration, Resolution No. 14-213, regarding a Bill for an Act Relating to Smoking, to be included in the 2015 HSAC Legislative Package, which was approved by the City and County of Honolulu on October 8, 2014. Secretary Martin stated that the proposal was initiated by former HSAC Secretary Chang and is intended to prohibit smoking on beaches in their entirety. Page 3 of 6 Treasurer Victorino stated that he agrees with the concept of the proposed legislation but has enforceability concerns. President Rapozo stated that he would allow the Executive Committee to refer the proposal to the counties, but he will not support it at a council level. Maui Council Chair Balsa cautioned against passing too many unenforceable laws. Alternate Anderson stated that he understands concerns about unenforceability, but feels that appropriate signage may be sufficient to deter smoking on beaches. Secretary Martin stated that many initiatives related to public health have a self -enforcing perspective. Secretary Martin commented that the proposal would facilitate discussion of the issue at the county council and state legislature levels. Responding to a question from Vice President Onishi, President Rapozo stated that HSAC has an internal deadline for proposals for the HSAC legislative package, but Its up to the Committee whether or not to extend the deadline. Vice President Onishi stated that the Hawaii County Council has a practice of observing HSAC internal deadlines and did not consider proposals that were brought before the council after the deadline had passed. Vice President Onishl indicated that he would not support the proposal prohibiting smoking on beaches and the following proposal relating to meetings based on the lapsing of the deadline. A motion was made and approved to receive the item. C. Discussion and consideration of a proposed Bill for an Act Relating to Community Meetings, which amends Section 92-2.5 of the Hawaii Revised Statutes, to be included in the 2015 HSAC Legislative Package. This proposal was approved by the Maui County Council via Resolution No. 14-117 at its meeting on October 17, 2014. A motion was made and approved to receive the item. Page 4 of 6 President Rapozo stated that if not for the lapsing of the deadline he would have supported the proposal and encouraged the counties to submit similar proposals. At 10:00 a.m., Secretary Martin left the meeting, and quorum was fulled by Honolulu Alternate Anderson. D. Discussion regarding the 2015 Western Interstate Region (WIR) Conference being held at the Grand Hyatt Kauai Resort & Spa on May 2D- 22,2015. President Rapozo stated that about $100,000 will be needed to host the conference. He indicated that the counties will be requested to assist with soliciting sponsorships. VII. ANNOUNCEMENTS A. Next Meeting Dates: 1. Thursday, November 13, 2014, at Honolulu Hale. a. 9:00 a.m. — Executive Committee Meeting b. 10:00 a.m. — General Membership Meeting 2. Tentative: Friday, December 5, 2014, at the Grand Wailea in the Pikake Room Treasurer Victorino stated that difficulties have arisen with regard to scheduling a meeting in Maui on December 5, 2014. President Rapozo stated that the December 2014 meeting will be scheduled at the November 13, 2014 meeting. Treasurer Victorino suggested that the December 2014 meeting be held in Honolulu because the newly elected legislators will have taken office. B. Other announcements.
