No. 185-15 PLACE: Council Chambers Hilo, Hawaii TIME: 9:03 a.m. Council Chair and Members Hawaii County Council Hilo, HI 96720 Your Committee on Governmental Relations and Economic Development, to which was referred Resolution No. 185-15, reports follows: Resolution No. 185-15, transmitted by Council Member Daniel Paleka Jr., via Communication No. 292, dated April 17, 2015, requesting the Hawaii State Legislature to recognize July 31 as "La Ho `iho `i Ea," which translates to Restoration Day. Mr. Paleka entered a motion to approve Resolution No. 185-15, seconded by Ms. Wille. He provided brief clarification on how this resolution came forth. Mr. Paleka requested an individual representing Kanaka Council Moku O Keawe to come forward to present historical information on the importance of La Ho`iho`i Ea. The individual referenced an article, published in the February 16, 1907 edition of the New York paper, Harpers Weekly. The article focused on Japanese in Hawaii and how the children were so well behaved and taught from a young age to honor and protect the American flag, and how the U.S. government is still doing it today. The individual further elaborated on La Ho`iho`i Ea. He specifically pointed out that the origin of our State motto "Ua mau ke ea o ka `aina i ka pono" is derived from July 31st or La Ho`iho`i Ea. He mentioned this day was celebrated annually by Native Hawaiians up until the illegal overthrow of the Hawaiian Kingdom. Chair Onishi offered Council Members and the public the opportunity for comments and questions. Ms. Wille thanked the public for expressing their sovereignty and working to advance it. Ms. Wille mentioned, although she and many others may not be Hawaiian, she cherishes justice. It is from this perspective that she honors and appreciates their efforts. Ms. Wille elaborated on possible amendments to Resolution No. 185-15, and wanted suggestions from the public on how the Resolution can be stronger in regards to proclaiming specific Native Hawaiian holidays. GREDC — 1 Page 2 June 2, 2015 One individual mentioned Resolution 185-15 should be drafted in `Olelo Hawaii for the Council to consider. He also added that he would like the County to declare this a holiday and forward this to the State Legislature Ms. Wille asked Corporation Counsel Molly Stebbins to come forward and provide clarity on the authorities of the County in regards to holidays. According to Ms. Stebbins the County has the authority to designate a day in commemoration of an event, but as far as the County establishing a holiday, she was not sure. Chair Onishi asked of Ms. Stebbins to research the powers and authorities of the County Council in regards to holidays and requested of her to provide her findings to the Council. Ms. Wille requested more clarification from the public in regards to the Queen's birthday and the Hawaiian Independence Day, La Ku`oko`a. One individual suggested these significant dates be established a State and Federal holiday also. Ms. Wille reiterated her support for this Resolution upon yielding. Ms. Eoff thanked the testifiers for their attendance and expressed her appreciation to Mr. Paleka for introducing this Resolution. She suggested an amendment to remove a portion of the fifth whereas clause where it states, this day is not and shall not be construed to be a State holiday. She briefly spoke in support of the resolution and then yielded. Chair Onishi recommended any amendments for Resolution 185-15 should be introduced at the next meeting of the Council on June 16, 2015. Ms. David spoke in strong support for this Resolution and for Ms. Eoff s proposed amendments. She made brief comments on the importance of the Hawaiian culture. She referenced in the 1970's there were no written history of the Hawaiian culture in our State schools and State libraries and how she is proud of the progress we have made as a society within the last forty five years. Council Chair Kanuha thanked the public for their passion and for spreading awareness of the Hawaiian culture and history of its people. He thanked Mr. Paleka for bringing this measure forward. Mr. Eagan thanked Mr. Paleka for allowing him the opportunity to learn more about the Hawaiian culture. He requested Ms. Stebbins to explain the power of proclamations. Ms. Stebbins clarified that the Mayor and the Council has the authority to proclaim and recognize a day in the County of Hawaii. Chair Onishi asked Mr. Paleka to offer a summary prior to a Committee roll call. Mr. Paleka requested to make a verbal floor amendment to the Resolution. Clerk Maeda suggested a written amendment for the purpose that the amendment is more than a typographical change. Mr. Paleka agreed to submit written amendments at the next meeting. He further thanked the public for their passion and their patience. GRF,DC — 1 Page 3 June 2, 2015 Chair Onishi called for a roll call vote.
