SUBJECT: Bill 32, an ordinance amending Chapter 14, Hawai`i County Code 1983
(2005 Edition, as amended) by adding a new article relating to disposal of
refuse in a manner that rewards those who separate their recyclables and
compostables from landfill refuse.
Attached please find a memo from Chair Thom Randle of the Environmental
Management Commission.
Please place Bill 32 on the next available Committee agenda.

Subject: Referral of Bill 32, an ordinance amending Chapter 14, Hawaii County Code 1983
(2005 Edition, as amended)by adding a new article relating to disposal of refuse
in a manner that rewards those who separate their recyclables and
compostables from landfill refuse;and Bill 33, an ordinance amending Chapter 2,
article 40, section 2-202;chapter 20, article 3, sections 20-31, 20-35, and 20-36;
and Chapter 20, article 5,section 20-43 and section 20-52, and adds a new
section to Chapter 20,article 3,of the Hawai'i County Code 1983 (2005 Edition,
as amended), relating to refuse.
Pursuant to section 2-207 of the Hawaii County Code (HCC),we are required to respond to
your request for review and recommendation of the subject Bills within a 45-day period.
The Environmental Management Commission's(EMC) meeting scheduled for April 22, 2015 was
cancelled due to lack of quorum and the EMC will not reconvene until after the 45-day review
deadline of May 20,2015, so we will not have the opportunity to comment on these bills.
Section 2-207, HCC, provides as follows: "In the event that the commission fails to act within
the forty-five-day review period, such inaction shall be considered as an unfavorable
recommendation."

I would like to request that the Council provide an extension of the 45-day response deadline or
resubmit the referrals of these two bills to EMC to allow the commission to obtain quorum and
provide a response to the Council.
The commission's next meeting is scheduled for May 27, 2015.
