SUBJECT: Comments on Bill 32, an ordinance amending Chapter 14, Hawaii County
Code 1983 (2005 Edition, as amended) by adding a new article relating to
disposal of refuse in a manner that rewards those who separate their
recyclables and compostable from landfill refuse.

Subject : Comments on Bill 32, an ordinance amending Chapter 14, Hawai'i County Code
1983 (2005 Edition, as amended) by adding a new article relating to disposal of
refuse in a manner that rewards those who separate their recyclables and
compostables from landfill refuse
The Environmental Management Commission (EMC) appreciates the opportunity to provide
input regarding Bill 32. The EMC supports the intent of this bill to prevent recyclables and
compostables from entering the landfill. The following comments are provided for your
consideration:
a) General:The proposed ordinance would be more appropriately included under Chapter
20, Section 14.
b) Section 14—Required Implementation of PAYTIL: Successful implementation by the
Department of Environmental Management (DEM) will require an increase in the
Department Budget for both personnel and equipment. The DEM Solid Waste Division
(SWD) is preparing an analysis of funding necessary to successfully implement PAYTIL.
c) An ordinance providing DEM with authority to monitor, control and provide citations to
persons in violation of PAYTIL Ordinance must be set forth and approved by the Council.
d) Section 14—Distribution of EM bags/tags:
1) Distribution logistics are challenging, complicated and costly.
2) Multiple distribution locations would be required.
3) Documentation/control system will be required to document and monitor tags.
4) Options to purchase bags at local businesses should be pursued.
e) Section 14- Fee Schedule:
County of Hawai`i is an Equal Opportunity Provider and Employer.
1) It is suggested that additional EM bag costs be set at$4 per 33 gallon bag and 15
gallon bags should not be considered.
2) If 15 gallon bags are desired, cost of$2 per bag should be set.
3) Chapter 20, Section 14 should address the Section 14 Fee schedule for landfill
refuse sub paragraph "d" addressing cost for landfill refuse by weight.
f) Additional considerations:
1) Option for automated monitoring of residential use of transfer station should be
researched. One suggestion is for use of remote "scan" device similar to toll
booth monitoring/billing systems. Residents utilizing transfer stations would be
tracked and billed a cost when usage exceeds once per week. Such a system
would greatly simplify monitoring and enforcement, reduce requirement for
additional personnel and preclude requirement for special bag/tag purchase.
2) Recycle, reduce, reuse education efforts should be funded and increased to
maximize different media sources and opportunities.
3) Further incentivize diversion and recycling such as expanding HI-5 redemption
program to include additional recyclables. Rewarding for recycling rather than
penalizing for not recycling would be preferable.
4) Additional resources to research and consult with relating to PAYTIL might be the
US EPA, State DOH and Recycle Hawaii.
