RESOLUTION NO. 216 15
RESOLUTION AUTHORIZING THE DEPARTMENT OF RESEARCH AND
DEVELOPMENT TO AWARD FUNDS TO THE COUNTY OF HAWAI`I'S
FOUR (4) SOIL AND WATER CONSERVATION DISTRICTS
WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(B) of the Hawaii County
Code (2005 Edition as amended) states, "Grant awards in excess of$25,000 to
organizations that do not qualify as nonprofit organizations shall specifically identify the
purpose for which the funds shall be used in an ordinance or resolution and be subject
to competition in compliance with chapter 103D of the Hawaii Revised Statutes."; and
WHEREAS, Chapter 2, Article 25, Section 2-136(5) of the Hawaii County Code
states, "nonprofit organization" means an organization organized for other than profit-
making purposes and which has a current 501(c)3 tax-exemption from the Internal
Revenue Code; and
WHEREAS, the County's Soil and Water Conservation Districts are quasi-state
agencies whose mission is to take available technical, financial and educational
resources and coordinate them to meet the needs of local land users for conservation of
soil, water and related resources; and
WHEREAS, the Department of Research and Development wishes to provide
funds to the four (4) Soil and Water Conservations Districts as follows:
• Ka`u District (Ka'u, Puna and Waiakea): $150,000
• Mauna Kea: $ 50,000
• Hamakua: $ 50,000
• Kona: $ 50,000
; now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with Chapter 2, Article 25, Section 2-139(a)(3)(B) of the Hawaii County
Code, the Department of Research and Development is authorized to provide grants to
the County's four (4) Soil and Water Conservation Districts as indicated above.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall
transmit copies of this resolution to the Office of the Mayor, the Finance Department,
and the Department of Research and Development.
