Please waive this bill from the Finance Committee and place it on the July 24, 2015 Council Agenda in order to expedite this time sensitive matter. REQUEST: An ordinance amending Ordinance 15-58, the Capital Budget by adding an appropriation for: Land acquisitions to resolve an inadvertent approval by the Hawaii County Planning Department: $1,000,000 B. BACKGROUND AND JUSTIFICATION OUSE ADDITIONAL SHEETS AS NEEDED. The basis for the amendment is to resolve an inadvertent approval by the Hawaii County Planning Department for a two (2) lot consolidation and subdivision application of a property located within the State Land Use ("SLU") Conservation District without first obtaining authorization from the Department of Land and Natural Resources ("DLNR"). Pursuant to Chapter 183C of the Hawaii Revised Statutes and the related administrative rules, the consolidation and resubdivision of property located within the SLU Conservation District requires a Conservation District Use Permit ("CDUP") issued by DLNR. Unfortunately, this subdivision application was approved without first obtaining the required CDUP. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawai`i, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review.
