RE: RESOLUTION AUTHORIZING CERTAIN CODE EXEMPTIONS
FOR WEST HAWAII SENIOR LIVING, TAX MAP KEY:
3) 7-5-017 : 005
West Hawai'i Health LLC, is the tenant and developer of the
14-acre parcel for the project to construct ninety-six (96)
assisted living residences, one hundred sixty (160) skilled
nursing and long-term care residences and thirty-five (35)
employee housing apartments . One hundred forty-seven (147 ) of
the two hundred ninety-one (291) housing units of the total
project will be affordable in accordance with Section 201H of
the Hawaii Revised Statues (HRS) .
West Hawai'i Health LLC, has responsibly developed and
constructed assisted living facilities on Maui and O 'ahu. The
operation of West Hawaii Senior Living will be by Covenant
Retirement, a 125 year-old faith-based non-profit organization
operating in more than 15 communities across the country.
West Hawai'i Health LLC, will satisfy the affordable housing
requirements of West Hawai'i Senior Living (formerly Lava
Kuakini) by providing twenty-four (24 ) units affordable to
families earning less than sixty percent of the median income,
eighteen (18) units affordable to families earning below eighty
percent of the median income, and one hundred five (105) units
to be affordable to families earning less than one hundred
percent of the median income .

pursuant to HRS Section 201H-38, in conjunction with HRS 46-
15 . 1, to allow the County, with approval of the County Council,
to exempt low-income housing projects from certain code
requirements to facilitate the development of the project .

RE: RESOLUTION NO: 239-15 : AUTHORIZING THE EXEMPTION OF CERTAIN
CODE REQUIREMENTS, PURSUANT TO SECTION 201H-38 AND SECTION 46-15
OF THE HAWAII REVISED STATUTES, FOR HUALALAI HEALTH, LLC, KONA,
HAWAII, COVERED BY TAX MAP KEY (3) 7-5-010:061.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Human Services and Social Services to the full Council for
immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter be placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Committee on Human Services and Social Services for placement
on its future agenda.
