No. 357/Bill No. 62 PLACE: Council Chambers Kona, Hawai`i TIME: 11:05 a.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Public Works and Parks and Recreation, to which was referred Bill No. 62, reports as follows: Bill No. 62, transmitted by Council member Dennis `'Fresh" Onishi via Communication No. 357 dated June 25, 2015, amends Article VI, Chapter 3, Section 6-3.4, of the Hawai`i County Charter (2014), relating to County Bands. The bill removes language specifying that bandmasters and band employees are appointed and exempt from civil service laws and classifications. Council Member Onishi explained that Bill No. 62 is a housekeeping measure to correct the Hawai`i County Charter. He noted that in the charter it states that the bandmaster is appointed by the mayor and band employees are appointed by the bandmaster. He said that removal of this language will bring the charter consistent with current practice. Mr. Onishi clarified that members of the county band are civil service employees pursuant to state law. Corporation Council Molly Stebbins appeared before your committee for questions. She confirmed that the bandmaster and band members are recruited and employed per civil service laws. Council Member Eoff questioned why this wasn't clarified in the charter back when a similar bill was presented but not passed. Council Members Chung and Wille expressed their support for removing Section 6-3.4 from the county charter in its entirety. Council Member Onishi stated that in the next council meeting he would propose an amendment to remove all of Section 6-3.4. PWPRC Rept. No.: 11 PWPRC-11 Page 2 July 23, 2015 Ms. Stebbins stated that the county charter can't conflict with the state civil service law and that the language being removed is in conflict with Hawai`i Revised Statutes provisions regarding civil service. She stated that the bill will bring the language consistent with current practice and what state civil service law requires.
