The speed limit along Railroad Avenue from Leilani Street to a point eight hundred and forty (840) feet south of Kukila Street is covered under our maximum speed limit section of the Traffic Code. We conducted a speed study consisting of trial runs of the other paved sections of Railroad Avenue and determined that a speed limit of thirty-five (35) miles per hour is appropriate. Request the Hawaii County Code, Chapter 24, Article 10, Section 24-257, Schedule 5 (35 mile per hour limit) be amended. AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, section 24-257, schedule 5, of the Hawaii County Code 1983, relating to 35 mile per hour speed limits, is amended by adding a new item to be appropriately numbered and to read as follows: "( ) Railroad Avenue, from a point eight hundred forty feet south of Kukila Street to its southern terminus." SECTION 2. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 4. This ordinance shall take effect upon its approval. No. Dater .I 11 N. 1 9 1 91 #- REPORT OF THE C ,MITTEE ON PUBLIC WORKS DATE: June 10, 1991 PLACE: Councilroom TIME: 9:00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works, to which was referred Communication No. 2550 and its attached Bill No. 433, entitled "An Ordinance Amending Chapter 24, Article 10, of the Hawaii County Code 1983, Relating to Traffic Regulations", reports as follows: Bill No. 433 proposes to amend Chapter 24, Article 10, Section 24-257, Schedule 5, of the Hawaii County Code 1983, relating to 35 mile per hour speed limits, by adding a new item. The purpose of the bill is to establish a speed limit on Railroad Avenue from a point 840 feet south of Kukila Street to its southern terminus. Communication No. 2550 from Chief Engineer Bruce McClure states that the Department, in response to a request for a speed limit along Railroad Avenue, conducted a speed study and determined that 35 miles per hour is appropriate. He also noted that the speed limit on Railroad Avenue from Leilani Street to a point 840 feet south of Kukila Street is presently covered by the maximum speed limit section of the Traffic Code. Your Committee on Public Works has reviewed Communication No. 2550 and Bill No. 432. Your Committee understands that Section 24-149(a)(2), Hawaii County Code 1983 sets a 30 miles per hour maximum speed limit in a business district unless otherwise specified in the Code. The proposed 35 miles per hour zone on Railroad Avenue will extend from a point 840 feet south of Kukila Street to the south end of the paved portion. Your Committee on Public Works is in accord with the intent and purpose of Bill No. 433 and recommends-i-tA passage on first reading by the County Council. A MERLE K.
