SUBJECT: TRAFFIC CODE AMENDMENT
Railroad Avenue, Proposed No Parking at Anytime
We received a request to authorize a No Parking Zone along Railroad Avenue
at Kukila Street. Our investigations show parked vehicles along the
north-west side of Railroad Avenue restricts sight distance for motorists
entering Railroad Avenue from Kukila Street.
We request the Hawaii County Code, Chapter 24, Article 10, Section 24-280,
Schedule 28 (No Parking at Anytime) under South Hilo be amended.
A location map is attached for your information and use.

ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII
COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 24, article 10, division 5,
section 24-280, schedule 28, of the Hawaii County Code 1983,
relating to no parking at any time, is amended by adding the
following items to be appropriately numbered and to read as
follows:
( ). RAILROAD AVENUE, west side, beginning at a point
one hundred seventy-five feet north of Kukila
Street and extending four hundred seventy four
feet in the southerly direction.
SECTION 2. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or

applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its
approval.

Your Committee on Public Works, to which was referred Communication
No. 2449 and its attached Bill No. 417 entitled "An Ordinance
Amending Chapter 24, Article 10, of the Hawaii County Code 1983,
Relating to Traffic Regulations", reports as follows:
Bill No. 417 proposes to amend Chapter 24, Article 10, Division 5,
Section 24-280, Schedule 28, of the Hawaii County Code 1983, relating
to no parking at any time by adding an item. The purpose of the bill
is to prohibit parking along the west side of Railroad Avenue
beginning at a point 175 feet north of Kukila Street and extending
474 feet to the south.
Your Committee on Public Works has reviewed Bill No. 417 and
Communication No. 2449 from Chief Engineer Bruce C. McClure, stating
that the Department, in response to a request for a no parking zone
along Railroad Avenue in the vicinity of Kukila Street, investigated
and found that parked vehicles along the northwest side of Railroad
Avenue restrict sight distance for motorists entering Railroad Avenue
from Kukila Street.
Your Committee also has reviewed Bill No. 417 Draft 2, which was
circulated. The Chair stated that the revised bill had been prepared
by the Corporation Counsel's office in response to her request for
corrections to the content and format of section 1, as follows:
1. Change "section 24-280" to "section 24-280(c)";
2. Change the plural form "items" to singular form "item";
3. Insert quotation marks around the item to be placed in the
County Code;
4. Delete the period after the closing parenthesis;
5. Change the street name from all capital letters to initial
capitals, i.e., change "RAILROAD AVENUE" to "Railroad Avenue".
Your Committee concurred with the Chair's recommendations to approve
Bill No. 417 and to amend it in the form of Bill No. 417 Draft 2, as
circulated.
