Date- SUBJECT: at SUBJECT: TRAFFIC CODE AMENDMENT PROPOSED PARKING PROHIBITED DURING CERTAIN HOURS AND NO PARKING AT ANYTIME: BANYAN PENINSULA The temporary parking restrictions presently in effect within the Banyan Peninsula has provided the Police Department a valuable tool in enforcing noise, litter and liquor violations. Due to these restrictions, the police have been able to minimize the loitering and drinking that previously occurred at night. The South Hilo Traffic Safety Committee reports that the parking prohibitions have been effective. The Hawaii Police Department, therefore, requests our support in permanently establishing parking restrictions along portions of Banyan Drive, Lihiwai Street and on the Liliuokalani Park Perimeter Road. These restrictions will not have an adverse affect on surrounding business establishments and County Park users because the restrictions are located away from business areas and/or occur during the non -business night time hours. We concur with the'Police Department and request the Hawaii County Code, Chapter 24, Article 10, Section 24-281, Schedule 29 relating to parking prohibited during certain hours and Section 24-280, Schedule 28 relating to No Parking at Anytime under S. AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, division 5, section 24-281, schedule 29, of the Hawaii County Code 1983, relating to parking prohibited during certain hours, is amended by adding the following items to be appropriately numbered and to read as follows: BANYAN DRIVE south side beginning at Lihiwai Street and extending five hundred forty one feet in the easterly direction, between the hours of the 11:00 p.m. and 5:00 a.m. S ) BANYAN DRIVE, east side, beginning at a point nine hundred forty feet east, northeast of Lihiwai Street and extending five hundred seventy one feet in the northeasterly direction, between the hours of 11:00 p.m. and 5:00 a.m. ( ) BANYAN DRIVE, west side, beginning at a point seven tenths mile Puna of Lihiwai Street and extending seven hundred eighty feet in the southerly direction towards Kamehameha Avenue between the hours of 11:00 p.m. and 5:00 a.m. S BANYAN DRIVE west side beginning at a point one hundred three feet south of Liliuokalani Park Perimeter Road and extending five hundred eighty five feet in the southerly direction between the hours of 11.00 p.m. and 5:00 a.m. ( ) BANYAN DRIVE north side, beginning at a point one thousand seventy eight feet southwest of Liliuokalani Park Perimeter Road to Lihiwai Street between the hours of 11:00 p.m. and 5:00 a.m. ( ) LIHIWAI STREET, east side, Banyan Drive to Liliuokalani Park Perimeter Road between the hours of 11:00 p.m. and 5:00 a.m. ( ) LILIUOKALANI PARK PERIMETER ROAD, beginning at a Point seven hundred twenty five feet west of Banyan Drive to Lihiwai Street between the hours of 11:00 p.m. and 5:00 a.m." SECTION 2. Chapter 24, article 10, section 24-280, schedule 28, of the Hawaii County Code 1983, relating to parking at anytime in south Hilo, is further amended by adding the following items to be appropriately numbered and to read as follows: "S ) BANYAN DRIVE, southeast side, beginning at a point five hundred forty one feet east of Lihiwai Street and extending three hundred ninety nine feet in the northeasterly direction. ( ) BANYAN DRIVE east side, beginning at a point six hundred twenty seven feet north of Kamehameha Avenue and extending three hundred thirty four feet in the northerly direction. ( ) BANYAN DRIVE west side, beginning at a point six hundred eighty eight feet south of Liliuokalani Park Perimeter Road and extending three hundred ninety feet in the westerly direction." SECTION 3. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. -2- SECTION 5. This ordinance shall take effect upon its approval. No..DEE C 5. 199�.- REPORT OF THE COMMITTEE ON PUBLIC WORKS " DATE: November 13, 1990 PLACE: Councilroom TIME: 9:00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works, to which was referred Communication No. 2078 and its attached Bill No. 356, entitled "An Ordinance Amending Chapter 24, Article 10, of the Hawaii County Code 1983, Relating to Traffic Regulations," reports as follows: Bill No. 356 proposes to amend Chapter 24, Article 10, Division 5, of the Hawaii County Code relating to parking by adding items to Section 24-281 and Section 24-280. The purpose of the bill is to restrict parking in the Banyan Peninsula by prohibiting it at any time in some areas and by prohibiting it between 11:00 p.m. and 5:00 a.m. in other areas. The intent of the bill is to provide the Police Department a valuable tool in enforcing noise, litter and liquor violations," according to Communication No. 2078 from Chief Engineer Bruce McClure. Your Committee on Public Works has reviewed Bill No. 356 and Communication No. 2078 from Chief Engineer Bruce McClure, dated October 23, 1990, which states the following: 1. The Police Department has been able to minimize loitering and drinking at night in the Banyan Peninsula through the use of temporary parking prohibitions; 2. The South Hilo Traffic Safety Committee reports that the parking prohibitions have been effective: 3. The Police Department has requested the establishment of parking restriction along portions of Banyan Drive, Lihiwai Street and the Liliuokalani Perimeter Road; 4. The restrictions will not have an adverse effect on surrounding business establishments and County park users because the restrictions are located away from business areas and/or occur during non -business hours; and 5. The Department of Public Works concurs with the Police Department and requests that the Traffic Code be amended. A Committee member questioned the bill's effect on adequate parking during shows at the hotels and suggested that 12 midnight would be a better starting time for the parking restrictions than 11:00 p.m. PWC REPORT NO, 131 ADOPTED: PWC -131 November 13, 1990 Your Committee concurred with the Chairwoman's recommendation to approve Bill No. 356 and to research the appropriateness of the 11:00 p.m. starting time before the Council meeting on November 21, 1990.
