As part of our review of this request, we inspected the road from Ha'aheo School to Kaiwiki Road and from Kaiwiki Road to Wailuku Drive. We conclude that because of its narrow pavement and shoulder, its numerous vertical and horizontal curves and its proximity to Ha'aheo School and Clem Akina Park, that 25 mph is the appropriate speed limit. The limit should be the entire length of Wainaku Street and not just between Ha'aheo School and Kaiwiki Road as suggested by the Big Island Traffic Safety Council. We request that the attached proposed bill of the Hawaii County Code, Chapter 24, Article 10, Section 24-255, Schedule 3 (25 mile per hour limit) be amended. AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII COUNTY CODE 1983, RELATING TO TRAFFIC REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, article 10, division 1, section 24-255, schedule 3, of the Hawaii County Code 1983, relating to 25 mile per hour speed limits, is amended by adding a new item to be appropriately numbered and to read as follows: "( ) Wainaku Street." SECTION 2. Chapter 24, article 10, division 1, section 24-258, of the Hawaii County Code 1983, relating to 35 mile per hour maximum speed limits, is amended by deleting the following item: "[(15) Wainaku Street.]" SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval. The Big Island Traffic Safety Council requested the speed limit change between Ha'aheo School and Kaiwiki Road. After inspection of Wainaku Street, the Department of Public Works concluded that the speed limit change should cover the road in its entirety due to its narrow pavement and shoulders, its numerous vertical and horizontal curves and the its close proximity to Ha'aheo School and Clem Akina Park. Chapter 24, Article 10, Division 1, Section 24-255, Schedule 3 (25 Mile Per Hour Limit) is amended by adding: "( ) Wainaku Street." Chapter 24, Article 10, Section 24-257, Schedule 3 (35 mile per hour limit) is amended by deleting: "[(15) Wainaku Street.]" Your Committee on Public Works concurs with the intent and purpose of Bill No. 137 and recommends its passage on first reading by the Council.
