Attached for your favorable consideration is proposed Bill No. 17, Draft 3, which amends
Condition K relating to the applicant's fair share contribution to mitigate regional impacts.
Because the subject property is in close proximity to the Waimea Park, the amendment deletes
the allocation for parks and recreation. In past rezonings where properties had sufficient
existing park facilities in the immediate area, the park assessment was deleted. This was a
standard practice of the Council to waive park assessments for developments in the area
without arbitrary exceptions.
