COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 283 15 A RESOLUTION TO NOMINATE ENTERPRISE ZONES FOR CONSIDERATION AND DESIGNATION BY THE GOVERNOR OF THE STATE OF HAWAII. WHEREAS, the County of Hawai`i encourages sound economic development on the Island of Hawai`i; and WHEREAS, the designation of Enterprise Zones in Hawai`i County provides approved businesses within such zones with tax incentives to foster economic development and generate employment; and WHEREAS, the County of Hawai`i will offer eligible businesses a three-year exemption from any increase in property taxes resulting from new construction in enterprise zones; and WHEREAS, the State of Hawai`i, through Chapter 209E, Hawai`i Revised Statutes and Chapter 6 of Title 15, Hawaii Administrative Rules, has established procedures for designating Enterprise Zones for the purpose of stimulating business and industrial growth; and WHEREAS, the County of Hawaii through Ordinance 94-08 enabled the establishment of, and codified as Chapter 31 in the Hawai`i County Code, an Enterprise Zone Program; and WHEREAS, Hawaii County Enterprise Zones are nominated by the County of Hawai`i and formally designated by the Governor; and WHEREAS, a designated Enterprise Zone retains such Enterprise Zone status for a twenty-year period; and WHEREAS, the twenty-year period for the designated zones of Hamakua, Hilo-Puna, and North Kona expired on October 1, 2014; and WHEREAS, the twenty-year period for the designated zone of Ka`u expired on May 1, 2015; and WHEREAS, the twenty-year period for the designated zone of South Kona will expire on April 1, 2016; and WHEREAS, the County of Hawai`i resolves to seek redesignation of the South Kona Enterprise Zone for a second twenty-year term, incorporate the area formerly designated as the North Kona Enterprise Zone into this zone, and rename the expanded contiguous area, the Kona Enterprise Zone; and WHEREAS, in addition to this new Kona Enterprise Zone, to continue the opportunity for job creation and to support agricultural businesses, the County of Hawai`i wishes to nominate Hamakua, Hilo-Puna, and Ka`u as three additional new Enterprise Zones; and WHEREAS, the following attached exhibits provide information about these four proposed new Enterprise Zones: (1) Map that shows proposed Enterprise Zones as well as current North Kohala Enterprise Zone—(Exhibit A) (2) Map that shows proposed zone boundaries relative to the boundaries of census tracts that will be fully or partially included in the zones and publicly held lands within the proposed zones—(Exhibit B) (3) Map that shows State land use classifications within the proposed zones— (Exhibit C) (4) Map that shows County general plan designations for areas within the proposed zones— (Exhibit D); and WHEREAS, all four of the proposed new Enterprise Zones satisfy the eligibility requirements for areas to be nominated for Enterprise Zone status; and WHEREAS, the Hawai`i County Council is empowered to request that the Governor designate the four new zones as Hawai`i County Enterprise Zones; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the following Enterprise Zones be established in Hawai`i County according to the attached exhibits that include maps and corresponding descriptions of each proposed zone's boundaries: (1) Hamakua— (Exhibit E) on the date of the Governor's designation; (2) Hilo-Puna—(Exhibit F) on the date of the Governor's designation; (3) Kona—(Exhibit G) on the date of the Governor's designation, provided that this Zone, formerly named the South Kona Enterprise Zone and now renamed the Kona Enterprise Zone, shall be redesignated for an additional twenty-year term; and (4) Ka`u—(Exhibit H) on the date of the Governor's designation. 2 BE IT FURTHER RESOLVED that the County of Hawai`i will offer eligible businesses a three-year exemption from any increase in property taxes resulting from new construction in enterprise zones. BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii shall transmit copies of this resolution to the Honorable David Ige, Governor of the State of Hawai`i; to the Honorable William Kenoi, Mayor of the County of Hawai`i; and to Mr. Luis Salaveria, Director of the Department of Business, Economic Development and Tourism.
