Re: Operating Budget
The State of Hawai`i Department of Transportation is providing federally derived fun --
totaling $105,045 to be used for the Office of the Prosecuting Attorney's Flex 2016 — •
Project 5 program. This program provides specialized training for the police, prosecutors
and judiciary.
Enclosed is a resolution to authorize the Mayor to enter into an agreement with the State
of Hawai`i Department of Transportation for this grant. Also enclosed is a bill for an
ordinance amending the Operating Budget by appropriating this $105,045 grant.

1) Requesting a resolution authrizing the Mayor to enter into an agreemenyo accept federal funds from the
Federal Highway Administration (FHWA) that has been awarded to the Hawaii County Prosecutor's Office.
The funds will be used to combat impaired driving. 10s1o45 Do T '1-
2) Requesting a bill for an ordinance to appropriate $ ,N for the !FIe 20 6--=Project '. This would
include ammending the budget to appropriate the funds to the project and creating a general ledger account
and revenue account for the funds.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The Office of the Prosecutor has requested funds in the amount of$105,045 to be used in the "Hawaii
County Office of the Prosecuting Attorney -Training" Program, also known as "Flex 2016 - Project 5".
These funds will be utilized to cover the costs directly related to providing specialized training for police,
prosecutors and the judiciary in the investigation and prosecution of individual drivers impaired by alcohol
and/or illicit substances. With the State of Hawaii having the highest percentage of alcohol-impaired traffic
fatalities, prosecutors and law enforcement officers statewide must be equipped with the most up-to-date
training and latest techniques in the investigation and prosecution of impaired drivers.
The funds will be used statewide to meet the objectives of the program: 1) training focused on crash
reconstruction and methods of crash investigations, 2) training to allow 100% of deputy prosecutors who
prosecute traffic related cases to be up-to-date on laws affecting these cases, and 3) training law
enforcement officers about technical investigation of crashes, negligent homicides, Operating Vehicle Under
the Influence of Intoxicants and other traffic offenses.
The funds are being awarded for the Federal Fiscal Year ro/01/2015 through 9/30/2016.

RE: Resolution No. 292-15 : Resolution authorizing the Office of the Mayor to enter
into an agreement with the State of Hawai`i Department of the Transportation pursuant
to HRS 46-7, to accept federal funds for the Office of the Prosecuting Attorney's DOT
Flex Program; and
Bill No. 96 : An Ordinance to amend Ordinance No. 15-57 as amended, the
operating budget for the County of Hawai`i for the fiscal year ending June 30, 2016.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
