Your Committee on Human Services and Public Works, to which was referred Communication
No. 1043 and attached Resolution No. 287, reports as follows:
The purpose of Resolution No. 287 is to provide for the acquisition of land for the connectability
of Ainaloa and Hawaiian Acres Subdivision roads. The Resolution authorizes Corporation
Counsel to "initiate proceedings in eminent domain" and to "negotiate terms of settlement,
subject to the approval of[the County Council] and the court before which such proceedings are
prosecuted." The area in question is located on the easterly side of road "9" at Keaau, Puna and
is more specifically described in Exhibit"1" attached to the Resolution.
Resolution No. 287 was introduced at the March 19, 1996 Committee on Human Services and
Public Works meeting. There were members of the public testifying in support of the
Resolution and others testifying against. Testimony against the Resolution was primarily
focused on the development of an"emergency access" road along "8" road in Hawaiian Acres
and not against the Resolution specifically seeking condemnation of land. Testimony against the
"emergency access" road ranged from concern regarding safety and design defects to alignment
questions. Mr. Norman Olesen, Deputy Planning Director, provided information and answered
questions for the Committee. He stated that the Resolution would provide the necessary land to
connect Ainaloa Drive to the subdivision roads in Hawaiian Acres. He also stated that the area to
be condemned had always been intended to be utilized as a connector road between the two
subdivisions. In his opinion, the condemnation would be appropriate regardless of the direction
taken for the "emergency access" road.
Your Committee is in accord with the purpose and intent of Resolution No. 287,"and
recommends its adoption.
