Your Committee on Finance, to which was referred Resolution No. 286-15, reports as follows:
Resolution No. 286-15, transmitted by Finance Director Deanna S. Sako, via Communication
No. 475 dated September 10, 2015, authorizes the addition and increase of basic fees in the Rules and
Regulations of the Liquor Commission of the Department of Liquor Control of the County of
Hawaii, State of Hawai`i.
The Rules would be amended to add basic license fees for Condominium Hotel ($1,200), Winery
($1,000), and Small Craft Producer Pub ($1,000); and to increase license fees for Caterer from $120
to $600.
Liquor Control Director Gerald Takase came forward and explained that fee setting and fee increases
must come before council pursuant to Hawaii Revised Statutes and that new classes are created by
the State Legislature.
Several council members made inquiries and expressed concerns, to which Mr. Takase responded
with clarification.
Pursuant to Sections 281-17(a)(4) of the Hawaii Revised Statutes, rules, when adopted as provided
in chapter 91 shall have the force and effect of law.
Pursuant to Section 281-17.5(c) of the Hawai`i Revised Statutes, any increase in the liquor license fee
structure shall only be initiated by the liquor commission seeking the change with the approval of the
county's legislative body and mayor.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 286-15, and
recommends its adoption.
