COUNTY OF HAWAII 1• �*--5 .'�r • STATE OF HAWAII . • 'GiN►� RESOLUTION NO. 326 15 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO NEGOTIATIONS FOR THE ACQUISITION OF TAX MAP KEY (3) 5-3-007:010 KNOWN AS HALELUA IN NORTH KOHALA, PURSUANT TO CHAPTER 2, ARTICLE 42 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED). WHEREAS, Chapter 2, Article 42 of the Hawai`i County Code established the Public Access, Open Space, and Natural Resources Preservation Fund; and WHEREAS, Section 2-215 of the Hawai`i County Code established the Public Access, Open Space, and Natural Resources Preservation Commission ("the Commission"); and WHEREAS, Section 2-217 of the Hawaii County Code provides, in pertinent part, that the Commission's first duty and responsibility is, "To develop and submit to the mayor, an initial island-wide prioritized list of qualifying lands worthy of preservation...Priorities shall be listed on an island-wide rather than district basis."; and WHEREAS, on December 26, 2014, the Commission submitted its 2014 Annual Report to the Mayor citing the purchase of Halelua in North Kohala as priority number one; and WHEREAS, Communication No. 163 from the Mayor, dated February 25, 2015, recommends that the Council accept the prioritized list as presented by the Commission; and WHEREAS, public access to Halelua is also the highest priority of the North Kohala Community Development Plan; and WHEREAS, Halelua is 50.312 acres and includes a mile-long coastal stretch contiguous with Hapu`u to Kapanai`a Cultural Corridor that is ranked as priority number two and an already preserved land at Kauhola Point; and WHEREAS, Halelua includes coves, the ancient O'hau heiau, and identified birthing sites for endangered Hawaiian monk seals; and WHEREAS, the owner of the land is willing to sell; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Director of Finance is hereby authorized to enter into negotiations for the acquisition of Halelua, covered by tax map key (3) 5-3-007:010, as shown in the attached "Exhibit A." BE IT FURTHER RESOLVED that the Director of Finance is authorized to initiate any funding mechanisms required for the acquisition of the Halelua property in accordance with Chapter 2, Article 42 of the Hawai`i County Code, relating to the Public Access, Open Space, and Natural Resources Preservation Fund. BE IT FURTHER RESOLVED that the County of Hawai`i welcomes help from Kohala community groups such as Kohala Lihikai, Kamakani '0 Kohala `Ghana, Malama Kohala Kahakai, Malama Na Wahi Pana '0 Kohala, Maika`i Kamakani '0 Kohala, Kohala Historic and Cultural Preservation Committee, and Hawaiian Islands Land Trust, which have all pledged to help seek additional funding for the purchase of these properties. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Mayor William P. Kenoi, the Director of Finance, the Director of Parks and Recreation, and the Public Access, Open Space, and Natural Resources Preservation Commission.
