Your Committee on Planning, to which was referred Bill No. 109, reports as follows:
Bill No. 109, transmitted by Mayor William P. Kenoi via Communication No. 524 dated
October 12, 2015, amends Condition E of Change of Zone Ordinance No. 94-06. Condition E of
Ordinance No. 94-06 states "Construction of the proposed commercial development shall be
completed within three (3) years from the effective date of this ordinance." The applicants, Eric and
Joslyn Hoota, request a five-year time extension from the date of approval of this amendment to
complete construction of a medical office building or other commercial development. They have been
unable to proceed with construction of the project due to unforeseen personal health issues and the
recent recession. The subject parcel covers 26,770 square feet.
The Windward Planning Commission, at its duly held public hearing on October 1, 2015,
recommended approval of this item.
The applicants appeared before the Council. Mr. Paleka asked why they had applied for the extension.
Ms. Hoota stated that they had passed the time limit for completion of the project, but were
committed to seeing it completed.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 109, and
recommends passage on first reading.
