Re: Agreement with the State of Hawaii Department of Public Safety
The State of Hawaii Department of Public Safety is requesting the County to donate two
trash compactors for use at their Kulani Correctional Facility (KCF) in Hilo. The KCF
currently contracts an external vendor to haul their trash at significant cost.
The County of Hawaii's Department of Environmental Management has two compacting
trailers that were scheduled for disposal by auction. In lieu of disposal, we request that
these compacting trailers be donated to the State of Hawaii Department of Public Safety
so that the KCF may compact and transport their rubbish without the use of an external
vendor.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State
of Hawaii Department of Public Safety in order to donate this equipment for their use,
and to provide indemnification for the County regarding the transaction. If you have any

PREPARE A COUNTY COUNCIL SUBMITTAL TO AUTHORIZE THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII, DEPARTMENT OF PUBLIC SAFETY, PURSUANT TO HRS
46-7, TO DONATE TWO (2) TRAILERS TO THE STATE OF HAWAII DEPARTMENT OF PUBLIC SAFETY
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The State of Hawaii, Department of Public Safety, by letter dated October 21, 2015 is asking for the
County's consideration to transfer two (2) compactors for use at their Kulani Correctional Facility (KCF). This
would allow KCF to refurbish into one working compactor to haul their rubbish. Currently they are using a
company to haul rubbish twice a month which has been costly for their facility.
Pursuant to HRS 46-7, Hawaii Revised Statutes, the Mayor of the County of Hawaii is authorized to
execute, on behalf of the County, an agreement and related documents with the State of Hawaii,
Department of Public Safety, in order to donate the trailers referenced above.

Dear Ms. Sako
If at all possible we would really appreciate having two old trash compactors
transferred to us for facility usage. We had a few compactors in the pass
transferred to us many years back and we used these compactors to make one
working compactor for the facility to use. But as years passed with all the wear
and tear of this working compactor has come to its end and no longer able to be
repaired, parts are not available and it has been impossible to keep this compactor
on the road legally.
We would greatly appreciate it if you could transfer two compactors to Kulani
Correctional Facility. We have the capability of refurbishing these two
compactors to make one working compactor for the facility. We have trucks to
haul the compactor from Kulani Correctional Facility to Hilo Solid Waste
Division and back. We are currently using a company to haul our rubbish twice a
month and it's been costly for the facility. We currently have approximately 200
inmates and Food Service Department does generate a lot of rubbish.
We would greatly appreciate these compactors and you would be saving the
facility a lot of money.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
