RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF AGRICULTURE,
AGRICULTURAL RESOURCE MANAGEMENT DIVISION PURSUANT TO HRS SECTION
46-7, TO DONATE A VEHICLE TO THE STATE AGRICULTURAL RESOURCE
MANAGEMENT DIVISION.
WHEREAS, the State of Hawaii Department of Agriculture, Agricultural Resource Management
Division maintains the Waimea and Honoka`a-Pa`auilo Irrigation Systems; and
WHEREAS, the Waimea and Honoka`a-Pa`auilo Irrigation Systems helps to provide local farmers
and ranchers with the necessary amount of water at a reasonable price; and
WHEREAS, due to budget cuts and a lack of manpower, the State of Hawaii Department of
Agriculture, Agricultural Resource Management Division has fallen behind on maintenance and has
difficulty acquiring the necessary equipment; and
WHEREAS, the County of Hawaii Department of Public Works has a dump truck that was
scheduled to be disposed of by auction; and
WHEREAS, the transfer of the surplus dump truck would provide the State of Hawaii Department
of Agriculture, Agricultural Resource Management Division with a much needed means to maintain the
Waimea and Honoka`a-Pa`auilo Irrigation Systems by assisting with the hauling away of fallen trees from
ditch areas and debris removed from screens using an excavator and the hauling of materials to the job
sites; and
WHEREAS, it is anticipated that the donation of the dump truck will help State of Hawaii
Department of Agriculture, Agricultural Resource Management Division to accomplish its larger tasks and
get the Waimea & Honoka`a-Pa`auilo Irrigation Systems back to its fullest capacity sooner than originally
scheduled; and

WHEREAS, Hawai`i Revised Statutes Section 46-7 requires that County departments obtain the
consent of the Council to enter into agreements with the federal or state governments respecting action to
be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other
assistance in connection with projects being or to be undertaken pursuant to those powers; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance
with Section 46-7, Hawai`i Revised Statutes, that the Mayor of the County of Hawai`i is authorized to
execute, on behalf of the County, an agreement and related documents with the State of Hawai`i
Department of Agriculture, Agricultural Resource Management Division in order to donate the vehicle
indicated above and provide indemnification for the County regarding the transaction.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai`i shall transmit
copies of this resolution to the Office of the Mayor and the Department of Public Works.
