A RESOLUTION ACCEPTING THE DEDICATION OF LOT B, BEING A PORTION
OF GRANT 3148, APANA 4 TO W.P. LELEIOHOKU, TAX MAP KEY: (3) 7-5-007:009
(POR.), SITUATE AT HONUAULA 1ST, DISTRICT OF NORTH KONA, ISLAND OF
HAWAII FROM KONA HOSPITALITY, LLC,A HAWAII LIMITED LIABILITY
COMPANY.
WHEREAS, Kona Hospitality, LLC ("Kona Hospitality"), a Hawai`i limited liability
company, are the owners of Lot B containing an area of 1,670 square feet more or less, identified
as a portion of Tax Map Key: (3) 7-5-007:009 (por.), situate at Honuaula 1st, District of North
Kona, Island of Hawai`i, as delineated in Exhibit "A" attached hereto; and
WHEREAS, Kona Hospitality received final subdivision approval for the above
referenced lot; and
WHEREAS, Kona Hospitality is desirous of dedicating the above road widening lot to
the County of Hawai`i for roadway purposes, and such dedication has been approved by the
County of Hawai`i Department of Public Works, and received dedication approval from the
Department of Water Supply, Planning Department and Department of Environmental
Management; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that
the Council may accept gifts, which include the dedication of land, on behalf of the County of
Hawai`i; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it
finds the subject subdivision and any improvements thereon are in full compliance with the
provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable
agencies.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and
Chapter 23 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of
Lot B, containing an area of 1, 670 square feet more or less, identified as a portion of Tax Map
Key: (3) 7-5-007:009 (por.), delineated on Exhibit "A" attached hereto, for public road purposes.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy
Corporation Counsel Renee N. Schoen; and (4) Matthew G. Jewell, Esq., Jewell & Krueger LLP,
75-5722 Kuakini Highway, Suite 208, Kailua-Kona, Hawai`i 96740.
