SUBJECT: Proposed Amendments to Resolution No. 362-16; A Resolution authorizing the
Director of Finance to negotiate a lease of real property, Old Job Corps site, situate at
Pi`ihonua, South Hilo, County and State of Hawai`i, identified as Tax Map Key:
(3)2-3-026:008,to the Hawai`i County Economic Opportunity Council.
Please see below proposed amendments to Resolution No. 362-16. The proposed amendments are
illustrated in Ramseyer format with respect to the contents of Resolution No. 362-16, (material to be
deleted is bracketed and stricken; material to be added is underscored).
1. The Enacting Clause is amended to read as follows:
"NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAI`I, that under Chapter 2, Article 9, Section 2-120 (a) (2) of the Hawai`i County Code,
the Director of Finance is hereby authorized to negotiate a [10 year] long-term lease(with
renewal options for additional [two 10 year] terms)with the Hawai`i County Economic
Opportunity Council, a nonprofit organization, without notice or appraisal, for 2.263 acres of
property identified as the Old Job Corps site of Tax Map Key: (3)2-3-026:008."
2. The final WHEREAS clause is amended to read as follows:
"WHEREAS, Article 19, Section 2-120 (b) provides such lease of real property to
nonprofit organizations may be made without notice or appraisal as required in Chapter 2,
Article 19 of the Hawai`i County Code; [[and].]"

RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A LEASE
OF REAL PROPERTY, OLD JOB CORPS SITE, SITUATE AT PI`IHONUA, SOUTH HILO,
COUNTY AND STATE OF HAWAII, IDENTIFIED AS TAX MAP KEY: (3)2-3-026:008, TO
THE HAWAII COUNTY ECONOMIC OPPORTUNITY COUNCIL
WHEREAS, pursuant to Executive Order No. 3773 setting aside land for public
purposes, the County of Hawai`i has control and management of real property described as
Parcel "A" of Tax Map Key: (3)2-3-026:008, situate at Pi`ihonua, South Hilo, County and State
of Hawai`i consisting of 24.947 acres, for use as a government office and community services
site; and
WHEREAS, Hawai`i County Economic Opportunity Council ("HCEOC"), a non-profit
organization, desires to lease a portion of that real property consisting of 2.263 acres referred to
as the "Old Job Corps" site and delineated on Exhibit"A" attached hereto, for purposes of
construction and development of a self-sustainable botanical garden, visitor center and other
related purposes; and
WHEREAS, HCEOC intends that the garden and visitor facilities serve as a visitor
attraction to educate visitors about Hawai`i's fragile and unique natural environment; a training
facility for low-income trainees in the maintenance of native landscapes and the cultivation of
rare and endangered plants; and a community service site for at-risk high school students, college
botany students and other members of the community; and
WHEREAS, Article 19, Section 2-120 (a) (2) of the Hawai`i County Code, provides that
the Council of the County of Hawai`i may, by resolution approved by a majority of members,
direct the Finance Director to negotiate the disposition of real property by leasing it to nonprofit
organizations, at such rentals and on such terms and conditions as deemed proper; and

WHEREAS, Article 19, Section 2-120 (b) provides such lease of real property to
nonprofit organizations may be made without notice or appraisal as required in Chapter 2,
Article 19 of the Hawai`i County Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that under Chapter 2, Article 9, Section 2-120 (a) (2) of the Hawai`i County Code, the
Director of Finance is hereby authorized to negotiate a long-term lease (with renewal options for
additional terms) with the Hawai`i County Economic Opportunity Council, a nonprofit
organization, without notice or appraisal, for 2.263 acres of property identified as the Old Job
Corps site of Tax Map Key: (3)2-3-026:008.
BE IT FURTHER RESOLVED that the monthly rental amount shall be in accordance
with the Minimum Rent Policy for New Dispositions of the State of Hawai`i Department of Land
and Natural Resources.
BE IT FURTHER RESOLVED that the Honorable William P. Kenoi, Mayor of the
County of Hawai`i is hereby authorized to execute said lease agreement on behalf of the County
of Hawai`i following its approval by the Council as noted herein.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) Finance Director Deanna Sako; (3) Deputy Corporation Counsel Renee
Schoen; and (4) Hawai`i County Economic Opportunity Council, 47 Rainbow Drive, Hilo,
Hawai`i 96720.
