14oJ~��os N...... <br /> COUNTY OF HAWAII --' �" % -'- STATE OF HAWAII <br /> •RESOLUTION NO. 374 16 <br /> A RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT A (ANIANI <br /> STREET, A 50-FEET WIDE RIGHT-OF-WAY ALONG WITH TWO DRYWELLS), <br /> BEING A PORTION OF GRANT 2030 TO KAIAKOILI, TMK: (3) 7-3-019:037, <br /> SITUATED AT KOHANAIKI, DISTRICT OF NORTH KONA, ISLAND OF HAWAII <br /> FROM 4.10 HAWAII LAND PARTNERSHIP, A HAWAII GENERAL PARTNERSHIP. <br /> WHEREAS, 4.10 Hawai`i Land Partnership, a Hawai'i general partnership, is the owner <br /> of Road Lot A (Aniani Street, a 50-feet wide right-of-way along with two drywells), containing <br /> an area of 16,981 square feet, more or less, respectively, identified as a portion of Tax Map Key <br /> No.: (3) 7-3-019:037, situated at Kohanaiki, District of North Kona, Island of Hawaii, State of <br /> Hawai`i, as delineated on Exhibit "A" attached; and <br /> WHEREAS, Condition E of Ordinance No. 04-103, required a 50-foot wide perpetual <br /> easement for ingress, egress, access and right-of-way purposes; and <br /> WHEREAS, 4.10 Hawai`i Land Partnership, a Hawai`i general partnership, is desirous <br /> of dedicating the above road lot to the County of Hawai`i for roadway purposes, and such <br /> dedication has been approved by the County of Hawai`i Department of Public Works, the <br /> Department of Water Supply, the Planning Department, and the Department of Environmental <br /> Management; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the <br /> Council may accept gifts, including real estate or any interest in real estate, on behalf of the <br /> County of Hawai`i; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it <br /> finds the subject subdivision and improvements thereon are in full compliance with the <br /> provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable <br /> agencies, and that it is in the public interest to accept such dedication. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai'i County Charter, and <br /> Chapter 23 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of <br /> Road Lot A (Aniani Street, a 50-feet wide right-of way along with two drywells), containing an <br />
