A RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT A (ANIANI
STREET, A 50-FEET WIDE RIGHT-OF-WAY ALONG WITH TWO DRYWELLS),
BEING A PORTION OF GRANT 2030 TO KAIAKOILI, TMK: (3) 7-3-019:037,
SITUATED AT KOHANAIKI, DISTRICT OF NORTH KONA, ISLAND OF HAWAII
FROM 4.10 HAWAII LAND PARTNERSHIP, A HAWAII GENERAL PARTNERSHIP.
WHEREAS, 4.10 Hawai`i Land Partnership, a Hawai'i general partnership, is the owner
of Road Lot A (Aniani Street, a 50-feet wide right-of-way along with two drywells), containing
an area of 16,981 square feet, more or less, respectively, identified as a portion of Tax Map Key
No.: (3) 7-3-019:037, situated at Kohanaiki, District of North Kona, Island of Hawaii, State of
Hawai`i, as delineated on Exhibit "A" attached; and
WHEREAS, Condition E of Ordinance No. 04-103, required a 50-foot wide perpetual
easement for ingress, egress, access and right-of-way purposes; and
WHEREAS, 4.10 Hawai`i Land Partnership, a Hawai`i general partnership, is desirous
of dedicating the above road lot to the County of Hawai`i for roadway purposes, and such
dedication has been approved by the County of Hawai`i Department of Public Works, the
Department of Water Supply, the Planning Department, and the Department of Environmental
Management; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the
Council may accept gifts, including real estate or any interest in real estate, on behalf of the
County of Hawai`i; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it
finds the subject subdivision and improvements thereon are in full compliance with the
provisions of Chapter 23 of the Hawai`i County Code as certified and approved by all applicable
agencies, and that it is in the public interest to accept such dedication.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai'i County Charter, and
Chapter 23 of the Hawai`i County Code, that the County of Hawai`i accepts the dedication of
Road Lot A (Aniani Street, a 50-feet wide right-of way along with two drywells), containing an
area of 16,981 square feet, more or less, identified as a portion of Tax Map Key: (3) 7-3-019:037
(por.), delineated on Exhibit "A" attached hereto, for public road purposes.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy
Corporation Counsel Ronald Kim; and (4) Robert Triantos, Attorney at Law, Carismith Ball,
LLP, 121 Waianuenue Ave, Hilo, Hawaii 96720 .
