AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAII COUNTY CODE 1983, ADDING ARTICLE 35, RELATING TO THE HAWAII COUNTY FAMILY VIOLENCE ADVISORY COMMISSION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 2 of the Hawaii County Code 1983, is amended to read as follows: "ARTICLE 35. Family Violence Advisory Commission. SECTION 35-1. Organization. There shall be a committee composed of a minimum of nine (9) but not to exceed fifteen (15) members who shall be appointed by the mayor. Any member of the committee may be removed by the mayor. A. Purposes of Commission: 1. Prevent and reduce family violence in the County of Hawaii. 2. Promote public awareness and education about family violence in the County of Hawaii. 3. To act to improve upon the services to victims and their families. 4. Promote and facilitate interagency training on the dynamics of family violence. 5. Identify community concerns and assist with the study and investigation of resources, activities and political attitudes in the community that would assist the Commission to address the family violence. 6. Enhance communication, promote cooperation and coordinate services between member agencies. B. Goals of the Commission: The goals of the Commission are to prevent and/or reduce family violence in the County of Hawaii by addressing island -wide issues and ramifications of family violence, to promote general public awareness, to offer judicial and inter -agency training and to provide the impetus for preventative measures and education directed at the community -at -large with emphasis on our children and youth. SECTION 35-2. Membership and Tenure. A. All members appointed by the mayor shall serve terms co -terminus to his term of office which automatically ends at 12:00 noon on the first Monday of December following any mayoral election. B. At the discretion of the mayor, reappointments are permissible. C. Ex -officio membership shall be permitted but these members shall not have voting privileges or be qualified for mileage or other financial reimbursements. Ex -officio members may be selected but not limited to the following entities: • Adult Protection Service/DHS • Alternatives to Violence (ATV) • Big Island Substance Abuse Council • Castle Program -2- Child and Family Services (CFS) Child Protective Services/DHS Children's Advocacy Center (CAC) Circuit Court DASH Department of Education/Child and Adolescent Division District Court Family Court, Third Circuit Family Crisis Shelter Inc. -Kona Family Support Services -Kona Hale Ohana Hawaii Community Mental Health Services Hawaii County Police Department Hawaii Island YMCA Hawaii Island YWCA Hilo Interim Home Hilo Medical Center Honokaa Hospital Island Crisis Help Line Kona Hospital North Hawaii Community Hospital Office of the Prosecuting Attorney Probation Services Resource Connection Three At -Large Members (No affiliation required) Transition Network UHH Women's Center -3- D. Any vacancy may be filled upon the recommendation of the Commission and approval of the mayor. E. Members shall receive no compensation but shall be reimbursed mileage and other expenses as pre -approved by the Commission. SECTION 35-3. The Commission shall have the authority to establish its rules of procedure for the conduct of its business, which shall contain the time and place of all regular or special meetings. It shall specify that a quorum shall be at least 50% of the total Commission's membership. SECTION 35-4. Before entering upon each members' duties, each commission shall subscribe to an oath of affirmation before a person duly qualified to administer said oath. SECTION 35-5. All proceedings of the Committee shall be in conformation to the requirements of the Hawaii Revised Statutes, Chapter 92, Public Agency Meetings and Records (Sunshine Law). SECTION 35-6. Powers and Duties of the Commission. A. It shall be the duty of the Commission to act in an advisory capacity to the mayor concerning matters pertaining to the subject of domestic and family violence and the Commission's effort to reduce and prevent domestic and family violence in the County of Hawaii, to act to improve upon the services to victims and their families, to increase public awareness and education about family violence throughout the Island of Hawaii, to recommend and assist in the implementation of procedural and other changes within the agencies and organizations to further the goals of the Commission and to recommend and assist in the creation of such entities as it finds necessary to implement and carry out those goals. The Commission shall enhance communication, promote cooperation and coordinate services between member agencies in order to seek overall improvement of services to the public and avoid costly duplication of services. The Commission shall, from time to time, inquire of agencies as to their goals and objectives in furthering the purposes of the Commission. B. The Commission shall initiate and pursue efforts to secure Federal, State, County and private sector grants and funding to carry out its goals and objectives. 1. It shall serve as the repository of said funds or shall provide a mechanism to do so and shall be responsible for the timely accounting of same. SECTION 2. Severability. If any provisions of this ordinance, or the application thereof to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or applications, and to this end, the provisions of this ordinance are severable. -5- SECTION 3. This ordinance shall take effect upon its approval.
