ORDINANCE NO.
AN ORDINANCE TO AMEND CHAPTER 9 (SUBDIVISION CODE), HAWAII COUNTY
CODE, AS AMENDED.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 9, Article 1, Sections 3.23 and 3.24 are
hereby renumbered to Chapter 9, Article 1, 'ections 3.24 and 3.25
respectively.
SECTION 2. Chapter 9, Article 1, Section 3 is hereby amended
by adding thereto the following subsection:
"Section 3.23. CONSOLIDATION . The combining of two or
more lots into one lot."
SECTION 3. Chapter 9, Article 2, Section 3.05 is hereby amended
to read as follows:
"Each application for a subdivision is subject to the
payment of the following fee: Fifteen dollars ($15.00) plus
three dollars ($3.00) per lot noted on the initial preliminary
plat or Cluster Plan Development and for each additional lot
resulting from any subsequent amendment of the initial preli-
minary plat exclusively of any lots set aside for roadway or
easement purposes or lands dedicated for public use.
"The above prescribed, shall riot apply to subdivision of
land into burial or crematory lots within the confines of
duly -established cemetery areas provided, however, that pro-
cessing fee will be filed as follows:
One hundred dollars ($100.00) per acre and pro-
portionate fee for fraction of acre thereof.
"The payment of the filing fee shall be made at the Plan-
ning Department's office and payable to the Director of Finance,
County of Hawaii. No portion of the fee is refundable for ap-
plications granted tentative subdivision approval. A portion
of fee equivalent to ten percent (10%) of the fee or five
dollars ($5.00), whichever is greater, shall be retained for
applications which have been withdrawn or denied before granted
tentative approval."
SECTION 4. Chapter 9, Article 2, is hereby amended by adding
thereto Section 4.12:
"Section 4.12. PUBLIC UTILITY OR PUBLIC RIGHTS-OF-WAY
SUBDIVISIONS.
"The requirements, including lot sizes, and standards of
this code shall not: be applicable to public utility and/or
public rights-of-way subdivisions and their remnant parcel(s);
provided, however, that the Director upon conferring with
the Chief Engineer and Manager of the Department of Water
Supply may require necessary improvements to further the
public welfare and safety."

SECTION 5. Chapter 9, Article 2, is hereby amended by adding
thereto Section 4.13:
"Section 4.13. CONSOLIDATION/RESUBDIVISION ACTION.
"The requirements and standards of this code shall not
be applicable to consolidation and resubdivision action re-
sulting in the creation of the same or less number of lots
than that which existed prior to the consolidation/resubdi-
vision action; provided, however, that the Director, upon
conferring with the Chief Engineer and Manager of the
Department of Water Supply, may require necessary improvements
to further the public welfare and safety."
SECTION 6. This ordinance shall take effect upon its approval.
