West Hawai`i Civic Center, Bldg.A, 74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawai`i 96740E TO: Members of the Hawaii County Council FROM: Dru Mamo Kanuha, Council Chair o k.ft DATE: January 21, 2016 SUBJECT: Proposed Amendments to Resolution No. 337-15, a Resolution Relating to a Council Initiated Improvement District to Facilitate Construction of Permanent Improvements to the Nalani Street Subdivision, at Holualoa 4, North Kona, Hawaii, Including Improvement of the Water Distribution System to County Standards, in Accordance With Chapter 12 of the Hawaii County Code 1983 (2005 Edition, as Amended) Relating to Improvements by Assessments. Please find attached proposed amendments to Resolution No. 337-15. The amendments are illustrated below in Ramseyer format with respect to the contents of Resolution No. 337-15 (material to be deleted is bracketed and stricken through, material to be added is underscored). A draft copy of Resolution No. 337-15, proposed Draft 2, is attached with the proposed amendments incorporated. 1. The title is amended to read as follows: "A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT TO FACILITATE CONSTRUCTION OF PERMANENT IMPROVEMENTS TO [THE] NALANI STREET [SUBDIVISION], AT HOLUALOA 4, NORTH KONA, HAWAII, INCLUDING IMPROVEMENT OF THE WATER DISTRIBUTION SYSTEM TO COUNTY STANDARDS, IN ACCORDANCE WITH CHAPTER 12 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING TO IMPROVEMENTS BY ASSESSMENTS.” 2. The first WHEREAS clause is amended to read as follows: "WHEREAS, it has been brought to the attention of the Council of the County of Hawaii that the water distribution system for [the] Nalani Street [Subdivision], located at Holualoa 4, North Kona, Hawaii, is not built to County standards; and" Comm. A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT TO FACILITATE CONSTRUCTION OF PERMANENT IMPROVEMENTS TO NALANI STREET,AT HOLUALOA 4,NORTH KONA, HAWAII, INCLUDING IMPROVEMENT OF THE WATER DISTRIBUTION SYSTEM TO COUNTY STANDARDS, IN ACCORDANCE WITH CHAPTER 12 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED) RELATING TO IMPROVEMENTS BY ASSESSMENTS. WHEREAS, it has been brought to the attention of the Council of the County of Hawai`i that the water distribution system for Nalani Street, located at Holualoa 4, North Kona, Hawaii, is not built to County standards; and WHEREAS,Nalani Street contains a mix of substandard service lines that connect to out-of-bounds meters and a few remnants of the original private line that is aged and deteriorating; and WHEREAS, to initiate the establishment of a water system improvement district, the Council must first request the Manager-Chief Engineer of the Department of Water Supply to prepare and submit to the Council a report containing information outlined in Chapter 12, Article 2, Section 12-10(a), Hawai`i County Code 1983 (2005 Edition, as amended); now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant to Chapter 12, Article 2, Subsection 12-10(a), Hawai`i County Code 1983 (2005 Edition, as amended), the Manager-Chief Engineer of the Department of Water Supply is hereby directed to prepare and submit to the Council a report containing the following: (1) Preliminary data concerning the special improvement proposed to be opened, constructed, or improved; (2) The general character and extent of any improvement to be proposed; (3) The proposed assessment unit and method of assessment; (4) Whether any new land will be necessary to be acquired, and the estimated cost thereof and the proportion of the cost which should be borne by the County; (5) The materials recommended to meet the conditions of the improvement; (6) The boundaries of the proposed improvement district and any subdistricts or zones therein as to which different portions of the cost of improvements should be charged; (7) The estimated cost of the improvement, the portions of the cost to be borne by the County, and the portions of the cost to be assessed against the assessment units specially benefited with the maximum unit of assessment to be made against each assessment unit to be assessed; and (8) All necessary plans and other data, details, and specifications for the improvements and any other matters or details intended to apply thereto. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Honorable Mayor William P. Kenoi and Department of Water Supply Manager- Chief Engineer Keith Okamoto.
