Re: Agreement with the State of Hawai`i
The Hawai`i County Public Access, Open Space and Natural Resources Preservation
Commission determined that Wai'opae, in the Puna District of Hawai`i, with Tax Map
Key (TMK) parcel (3) 1-4-02:22 as a site to increase public access to the shoreline,
increase educational opportunities, preserve and restore native habitat and protect the
Wai`opae Tidepools Marine Life Conservation District. The County applied for funding
by grant from the State of Hawai`i Department of Land and Natural Resources, Legacy
and Conservation Program for the acquisition of Wai`opae in the district of Puna. This
request was approved.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State
of Hawai`i in order to receive these grant funds. If there are any questions, please do not
hesitate to call Hamana Ventura from the Finance Department's Property Management
Division at 323-4321.

PREPARE A COUNTY COUNCIL RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAI`I, BOARD OF LAND AND NATURAL RESOURCES, AND TO
ACCEPT FUNDS FOR THE ACQUISITION OF TAX MAP KEY NO. (3) 1-4-002:022, WAI'OPAE (FKA
VACATIONLAND LAND TRUST) DISTRICT OF PUNA, ISLAND OF HAWAII.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
On September 15, 2014 the County of Hawaii applied for funding by grant from the State of Hawaii,
Department of Land and Natural Resources, Legacy Land Conservation Program for the acquisition of
Wai'opae in the district of Puna, Island of Hawaii. This request was approved on December 5, 2014 by the
Legacy Land Conservation Commission and by the Board of Land and Natural Resources on February 27,
2015.

Explanation: The FUND is strictly a balance account that receives quarterly deposits

certain factors.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
