ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAII COUNTY CODE 1983
(1995 EDITION) BY ADDING A NEW ARTICLE RELATING TO THE LEGISLATIVE
BRANCH AND ITS ABILITY TO CONTRACT FOR SERVICES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this measure is to allow the council chair,
rather than the mayor, to sign contracts involving the council and the office of the county
clerk.
SECTION 2. Chapter 2 of the Hawaii County Code 1983 (1995 Edition) is amended
by adding a new article to read as follows:
Article _. Legislative Branch
Section 2- . Council contracts. The county council may contract for services
necessary to the exercise of its legislative powers. The council chair shall execute contracts on
behalf of the council and the office of the county clerk. The execution of the contract shall be
sufficient to obligate the county, subject to approval by the corporation counsel as to form and
legality and certification by the director of finance as to the availability of funds."
SECTION 3. If any provisions of this ordinance or the application thereof to any
person or circumstance is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon its approval.
