AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5 OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION,AS AMENDED), RELATING TO
COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEE MEMBERSHIP AND
TENURE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose.
The purpose of this ordinance is to modify the terms of membership and tenure for
community development plan action committees to provide for better continuity of membership
and to allow interested members the opportunity to serve for a longer period of time.
SECTION 2. Chapter 16, article 3, section 16-5, Hawai`i County Code 1983 (2005 Edition,
as amended), is amended by amending subsection (b)to read as follows:
"(b) The members shall serve staggered terms of four years. Upon the initial appointment of the
committee, three members shall serve for a term of two years, three members for a term of
three years, and three members for a term of four years. When the term of a member
expires, the member [sem] may, at the discretion of the member, continue to serve until a
successor is appointed. [Members whose terms expire may not be reappointed for at least
additional term without the passage of two years' time.] Existing vacant positions shall be
filled before filling any position occupied by a member whose term has expired but who is
willing to continue serving until their position is filled. Any member whose initial term is
for one year or less remains eligible for reappointment for up to two full terms."
SECTION 3. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end the provisions of this ordinance are declared to be severable.
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need
not be included.
SECTION 5. This ordinance shall take effect upon its approval.
