SUBJECT: Proposed Amendments to Bill No. 154; An Ordinance to Amend to Article III,
Section 3-2, Hawai`i County Charter(2014), Relating to County Council Terms
Please find attached proposed amendments to Bill No. 154. The proposed amendments are
illustrated below in Ramseyer format with respect to the contents of Bill No. 154 (material to be
deleted is bracketed and stricken,material to be added is underscored). A draft copy of Bill No.
154, Draft 2, is attached with these amendments incorporated.
1. Section 1 of Bill No. 154 is amended to read as follows:
"SECTION 1. Article III, section 3-2 of the Hawai`i County Charter(2014), is
amended to read as follows:
"Section 3-2. Composition and Terms.
There shall be a county council composed of nine members. One member shall be
elected from each of nine districts. The terms of the council members shall be four years
and shall begin at twelve o'clock meridian on the first Monday of December after their
election. The terms of the council members shall not exceed [three] two consecutive four
year terms. Candidates shall be elected in accordance with the election laws of the state,
insofar as applicable.""
2. Section 5 of Bill No. 154 is amended to read as follows:
"SECTION 5. [Each-person] Any incumbent council member who is duly reelected to
serve as council member in the [20-1.6] 2018 elections, whether that be in the primary election or
general election, shall serve a four-year term and shall be eligible to serve [two] one additional
consecutive four-year [terms] term of office without regard for how many terms that person has
already served as a council member, whether those previous council terms were held
consecutively or otherwise." 7

3. Section 6 of Bill No. 154 is amended to read as follows:
"SECTION 6. Upon approval of the charter amendment proposed in this ordinance by a
majority of voters voting on this legislation in the 2016 general election, as duly certified,this
ordinance shall take effect at twelve o'clock meridian on December [5, 2016,] 3, 2018, and shall
apply to the terms of all council members duly elected in the [2-0-16] 2018 elections, whether that
be in the primary election or general election, and any election thereafter."

AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE III,SECTION 3-2
OF THE HAWAII COUNTY CHARTER(2014),RELATING TO THE COUNTY
COUNCIL TERMS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article III, section 3-2 of the Hawai`i County Charter(2014), is
amended to read as follows:
"Section 3-2. Composition and Terms.
There shall be a county council composed of nine members. One member shall be
elected from each of nine districts. The terms of the council members shall be [two] four
years and shall begin at twelve o'clock meridian on the first Monday of December after
their election. The terms of the council members shall not exceed [four] two consecutive
[two] four year terms. Candidates shall be elected in accordance with the election laws of
the state, insofar as applicable."
SECTION 2. Charter material to be repealed is bracketed and stricken. New
material is underscored. When revising, compiling, or printing these charter provisions
for inclusion in the Charter of the County of Hawai`i,the reviser need not include the
brackets,bracketed and stricken material, and underscoring.
SECTION 3. If any provision of this ordinance or the application thereof to any
person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance, which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are severable.
SECTION 4. Upon adoption of this ordinance, this Council, by appropriate
resolution, shall provide that this amendment be submitted to the electorate of Hawai`i
County for approval in the 2016 general election.
SECTION 5. Any incumbent council member who is duly reelected to serve as council
member in the 2018 elections, whether that be in the primary election or general election, shall
serve a four-year term and shall be eligible to serve one additional consecutive four-year term of
office without regard for how many terms that person has already served as a council member,
whether those previous council terms were held consecutively or otherwise.
SECTION 6. Upon approval of the charter amendment proposed in this
ordinance by a majority of voters voting on this legislation in the 2016 general election,
as duly certified,this ordinance shall take effect at twelve o'clock meridian on December
3, 2018, and shall apply to the terms of all council members duly elected in the 2018
elections, whether that be in the primary election or general election, and any election
thereafter.
