SUBJECT: Windward Planning Commission
Designation of"Redevelopment Area" for those certain Properties along
Banyan Drive, Lihiwai Street, and Kamehameha Avenue
Waiakea District of the City of Hilo, Hawaii
Transmitted herewith is the Windward Planning Commission's determination of those Federal,
State, and private properties within the Banyan Drive Peninsula, as highlighted on the enclosed
map, as a"blighted area" and therefore whose redevelopment is necessary to effectuate the
public purposes declared in Chapter 53, HRS pursuant to Section 53-1, HRS.
The authority for this request was made in accordance with Section 53-1, Hawai`i Revised
Statutes (HRS) regarding the Hawai`i Redevelopment Agency as administered by the County of
Hawai`i County Planning Department pursuant to Section 16-10 of the Hawai`i County Charter.
The Windward Planning Commission's determination and subsequent designation of portions of
the Banyan Drive peninsula as a"redevelopment area" initiates the creation of a redevelopment
agency pursuant to Chapter 53, Part I (Urban Redevelopment Act), HRS by the County Council.
Chapter 53-2 (a), HRS, Part I, states the council of a county by resolution may create a local
redevelopment agency for the county, which shall be a county agency and public body, corporate
and politic, and shall consist of five members, appointed by the mayor, with the approval of the
council, who shall be outstanding and public-spirited citizens and who shall have resided in the
county for at least three years immediately preceding their appointment.
By statutory definition, the "agency" means a local redevelopment agency of the county in which
a redevelopment project or the redevelopment project concerned is situated. Each agency shall
be designated by the name of the county followed by words"redevelopment agency". Therefore,

we propose the agency to be designated as the "Banyan Drive Hawaii County Redevelopment
Agency" (BDHRA).
Chapter 53-5 describes the powers and duties of the agency. This section is comprised of seven
(7) components, briefly highlighted as follows:
1. To undertake and carry out urban renewal projects and related activities authorized by
this chapter; and subject to any limitations in this chapter contained,to exercise all
powers necessary, incidental, or convenient to carry out and effectuate the purposes
and provisions of this chapter.
2. To make, amend, and repeal rules and regulations not inconsistent with this part to
carry into effect the powers and purposes thereof, which rules and regulations shall be
subject to chapter 91.
3. To appoint a manager and deputy manager who shall have such qualifications as the
agency deems necessary and who shall hold their respective offices at the pleasure of
the agency.
4. To make preliminary surveys, studies, and plans to identify redevelopment areas;
provided that the studies and initial determination of what areas are blighted, within
the meaning of this part, shall be made exclusively by the planning commission, and
to make redevelopment plans for the areas, which plans shall be in conformity with
the master plan for the development of the locality, and each plan shall show the
outline of the area, character of existing development,proposed use of land, general
character of new buildings and other general details of redevelopment, as well as the
estimated cost thereof In preparing redevelopment plans, the agency shall utilize
such assistance as can be given by employees of the government, but may also enter
into contracts for professional services in connection therewith.
5. To assist and cooperate with other local agencies within the State and to contract for
professional services with the other local agencies in carrying out its duties.
6. To establish and operate a central relocation office which shall perform such
functions and activities as may be necessary and proper for the satisfactory relocation
of families, individuals, businesses, and nonprofit organizations, incorporated and
unincorporated, displaced by any governmental action to decent, safe, and sanitary
locations at rents and prices within the financial means of the displaced families,
individuals, businesses, and nonprofit organizations.
7. To prepare a general neighborhood renewal plan for urban renewal areas which
may be of such scope that urban renewal may have to be carried out in stages over an
estimated period of up to ten years. The plan may include,but is not limited to, a
preliminary plan which(A) outlines the urban renewal activities proposed for the area
involved; (B)provides a framework for the preparation of urban renewal plans, and
(c) indicates generally the land uses,populations density, building coverage,
prospective requirements for rehabilitation and improvement of property, and
portions of the area contemplated for clearance and redevelopment. A general
neighborhood renewal plan shall, in the determination of the local governing body,

conform to the general plan of the locality as a whole and workable program of the
county.
In the initial stages, we suggest that the Planning Department as the lead agency in enabling the
County to directly exercise its powers as provided for in parts I and II of Chapter 53, HRS, under
Section 2-35.1 of the HCC, be designated as the lead agency for transitional purposes until the
BDHRA is organized and able to perform the duties as required.
Eventually, however, separate funding will be required for the BDHRA to be established as a
separate agency of the County pursuant to statutory requirements.
Attached herewith is also a resolution for the Councils introduction which provides the necessary
statement of authorities and other statutory requirements for the creation of the local
redevelopment agency. The Planning Department is not initiating this resolution but merely
providing a resolution for introduction by the appropriate Council member.
Finally, I am also enclosing an executed Statement of Understanding dated January 15, 2016
Between myself and Ms. Suzanne D. Case, Chairperson, State of Hawai'i Department of Land
and Natural Resources confirming the State's support and cooperation in this initiative. The
State owns or controls 90%of the lands within the designated redevelopment area.
I trust this information is sufficient enough to enable the Council to favorably consider and pass
a resolution establishing the agency pursuant to Chapter 53-2(a), HRS.

considered your above-referenced request for the designation of"redevelopment area"for the area
encompassing certain properties along Banyan Drive,Lihiwai Street and Kamehameha Avenue
located within the Waiakea District of the City of Hilo. This request was made in accordance with
Section 53-1,Hawaii Revised Statutes(HRS)regarding the Hawaii Redevelopment Agency as
administered by the County of Hawai`i County Planning Department pursuant to Section 16-10 of
the Hawaii County Charter.
The Commission voted to approve the designation of those Federal, State,and private properties
within the Banyan Drive Peninsula,as recommended by you and highlighted on the enclosed map,
as a"blighted area"pursuant to Section 53-1, HRS.
As so designated and provided by Section 16-10 of the Hawai`i County Charter, you or a
redevelopment agency established by County Council resolution may now undertake and carry out a
redevelopment project(s)within all or any part of this redevelopment area that may include the
planning, development,replanning,redesign, clearance,reconstruction or rehabilitation, or any
combination of these as deemed appropriate or necessary in the interest of the general welfare and
in accordance with procedures and authorities set forth in Chapter 53,Part I (Urban Redevelopment
Act)and Part II(Urban Renewal), HRS.

WHEREAS,the Waiakea Peninsula contains about eighty-five percent (85%) of the
overnight visitor accommodations in east Hawaii;
WHEREAS, the State,thru various leases, has provided little to no incentive for the
lessees of the properties in the area to make major investments in improvements to the
infrastructure, resulting in the deterioration and dilapidation of the areas infrastructure and
facilities,thereby creating a "blighted area," thus creating an area that causes both economic
and social liability for our island community;
WHEREAS, under the provisions of Chapter 53, Hawai'i Revised Statutes, as amended,
the County Council of the County of Hawai'i by resolution may create a local redevelopment
agency for the county, which shall be a county agency and a public body, corporate and politic,
and shall consist of five members, appointed by the mayor, with the approval of the council,
who shall be outstanding and public-spirited citizens and who shall have resided in the county
for at least three years immediately preceding their appointment;
WHEREAS, creation of the Banyan Drive Hawai'i Redevelopment Agency ("BDHRA")
would present an opportunity for the County to effectuate a revitalization and redevelopment
of the area where hotel, resort, commercial and public uses may coexist compatibly; and
WHEREAS, the BDHRA shall include the redevelopment areas as designated by the
County of Hawai'i Windward Planning Commission including those Federal, State and private
properties highlighted on Exhibit "A", attached hereto and incorporated by reference herein.
WHEREAS, in the initial stages,the Planning Department, as the lead agency in
enabling the County to directly exercise its powers as provided for in parts I and II of Chapter
53, HRS, under Section 2-35.1 of the HCC, be designated as the lead agency for transitional
purposes until the BDHRA is organized and able to perform the duties as required under the
statute.
BE IT RESOLVED, pursuant to Chapter 53, Hawaii Revised Statute, as amended,the
County Council of the County of Hawai'i hereby establishes the Banyan Drive Hawai'i
Redevelopment Agency ("BDHRA") which shall exercise its powers as provided for in parts I and
II of Chapter 53, Hawai'i Revised Statutes, as amended; and it does hereby authorize the Mayor
to appoint, with the approval of the council, five members to said Agency who shall reside in
the County for at least three years immediately preceding their appointments, one to serve for
a term of one (1) year, one for a term of two (2) years, one for a term of three (3) years, one for
a term of four (4)years, and one for a term of five (5) years, and thereafter, their successors to
serve for terms of five years, and no more than three of whom shall belong to the same political
party;

STATEMENT OF UNDERSTANDING
The County of Hawai`i ("County") and the State of Hawai`i,through its Department of
Land and Natural Resources("DLNR"),jointly announce an agreement to enter into a
collaborative process for the redevelopment of the Banyan Drive Peninsula(the"Project Area").
Both County and State parties acknowledge that certain areas within the Project Area
consist of real property that are underutilized or are in disrepair wherein investment has not been
at the level desired by the parties. The parties jointly support economic development and
revitalization of the area and therefore,the County in collaboration with the State,through
DLNR,will initiate an urban renewal project(hereinafter"the Project") for the Banyan Drive
Peninsula,pursuant to Chapter 53, Hawai`i Revised Statutes, Urban Renewal Law, Part I and 11.
The County, as provided under Section 16-10 of the Hawai`i County Charter and Section 2-35.1
of the Hawai`i County Code,currently retains the powers, functions,rules and regulations
formerly held by the Hawaii Redevelopment Agency through its Planning Department. The
Project,however,will be a completely new redevelopment agency specific to the Project Area.
The State,through the DLNR, supports this initiative and will cooperate with the County
to achieve the needed revitalization of the Project Area.
The goal of the Project will be to mutually work towards improving all of the Project
Area through a coordinated revitalization effort via the adoption and implementation of a master
urban redevelopment plan specifically for the Project Area.
